Synopsis

FLC OF MLG DEPARTING TUS HAD TCASII RA ON MIL ACFT MAKING AN OVERHEAD BREAK PREPATORY TO LNDG AT TUS.

Narrative

AT APPROX 800 FT ON TKOF; TCASII CALLS IN RAPID SUCCESSION TFC; TFC; MONITOR VERT SPD; REDUCE CLB; REDUCE CLB. CLB RATE WAS REDUCED IAW TCASII CALLS AND TCASII DOWNGRADED. I BELIEVE I HAD A FALSE TCASII 'RA' UNTIL ABOUT 4-5 SECONDS LATER; WHEN BOTH THE FO AND I SAW A MIL JET ABOUT 700 FT OFF OUR R WING IN A BREAK (R OVERHEAD) MANEUVER AT A HIGH BANK ANGLE. I WAS UPSET THAT THE PLT OF THE MIL JET CHOSE TO FLY SO CLOSE TO A TRANSPORT CATEGORY JET. TUS TWR COULD HAVE TOLD US IN ADVANCE AND WE MAY HAVE ELECTED TO DECLINE THE TKOF CLRNC. CORRECTIVE. WITH TCASII RELIABILITY AS IT IS; I ALMOST ALWAYS FOLLOW A TCASII 'RA' IMMEDIATELY UNLESS TFC SPOTTED; KNOWN; OR OTHER SPECIAL CONSIDERATION. AIRSPACE USE BY JOINT CIVIL MIL HIGH PERFORMANCE ACFT WHERE TCASII IS INVOLVED NEEDS TO BE REEVALUATED. TUS TWR SAID ALL LEGAL SEPARATION CRITERIA WERE MET AND I CAN BELIEVE THAT; BUT THAT IS NOT GOOD ENOUGH. NOBODY SHOULD BE FORCED OUT OF A TKOF PROFILE BELOW 1000 FT BY A TCASII 'RA' WITH LEGAL SEPARATION CRITERIA BEING MET. CRITERIA MUST BE CHANGED. FINALLY; I QUESTION THE JUDGEMENT OF THE MIL PLT OPERATING VFR THAT CLOSE TO A TRANSPORT JET; INEXCUSABLE!
