Narrative

MLG X INBOUND FROM NE TO LAND AT RDU. HE WAS LEVEL AT 6000 FT. AN SMT Y WITH PARACHUTE JUMPERS WAS CLBING TO LET JUMPERS OUT. HE WAS INSTRUCTED TO MAINTAIN 5500 FT. HE SAW THE MLG X AND CONTINUED A CLB WITHOUT APPROVAL FROM ATC. AS HE PASSED WITHIN 1/2 MI OF THE MLG X AND WAS AT THE SAME ALT; THE MLG X PLT DECLARED A TCASII ALERT AND CLBED FROM HIS ASSIGNED IFR ALT. THIS IS AN AREA THAT HAS BEEN RPTED ON BEFORE OVER RDU ARPT AND IT'S JUST A MATTER OF TIME BEFORE DISASTER STRIKES. SUPPLEMENTAL INFO FROM ACN 195442. WE WERE ON THE ARGL 2 ARR INTO RALEIGH DURHAM. APCH ADVISED US THAT WE HAD TFC AT 12 O'CLOCK AND HE WAS TO MAINTAIN 5500 FT. WE THEN RECEIVED A TA ON OUR TCASII SCREEN. I NOTED THAT THE TFC WAS CLBING AND ADVISED THE CAPT TO BE PREPARED FOR AN RA. WITHIN THE NEXT 10 SECONDS WE RECEIVED A COMMAND FROM TCASII TO CLB. AT THAT TIME I ADVISED THE CAPT THAT I HAD THE TFC IN SIGHT AND HE APPEARED TO BE IN A CLBING R TURN. THE TFC PASSED OFF OUR R AND WE THEN DSNDED FROM 6700 FT TO 6000 FT. NO INJURIES OCCURRED AS A RESULT.
