C182 pilot departing an airport before the Tower opened reported a conflict with a hot air balloon which was on the side of the runway fully expanded.
Narrative
I was at ZZZ prior to the tower operating. I obtained the current weather; taxied to the runup area and performed the pretakeoff checklist. I notified on CTAF that I was departing RWY XX eventually turning to the west. As I took the runway I noted a hot air balloon at about 200 feet west of the runway. My estimation was about 500 ft from the runway but I did not have a range finder. There was no radio response from that pilot. I thought I would not be too close to the balloon and decided to takeoff. I did wiggle my wings so the pilot knew I had him in sight. Then as I was going down the runway I noted a second balloon on the east side of the runway. This one was such the basket was on the ground not moving but the balloon was fully expanded with hot air. This was less than 500 ft from the runway. At this point I continued my takeoff. Then I proceeded to ZZZ1 to do some IFR practice work. I spoke to a balloonist pilot about this. His take was that the one balloon on the ground was 'in flight' as the balloon was fully expanded despite the basket on the ground and not moving. So I read all about this in the FAR AIM but could not get any guidance other that the fact that the balloon in the air has the right of way. I will contact our local FSDO for some guidance here as the balloons fly here prior the the tower opening. I tend to fly early to avoid traffic. Also the balloonist do not necessarily carry radios nor ADS-B.
