Corporate jet crew reported a near miss with a second aircraft during a climb after completing a TCAS RA guidance maneuver for a first aircraft encounter. The pilot followed the second TCAS RA guidance to perform an evasive maneuver and avoid the second aircraft.

Synopsis

Corporate jet crew reported a near miss with a second aircraft during a climb after completing a TCAS RA guidance maneuver for a first aircraft encounter. The pilot followed the second TCAS RA guidance to perform an evasive maneuver and avoid the second aircraft.

Narrative

Cleared for take off from runway 16R at the VNY airport. Just after passing the departure end of the runway; which had a restriction to be at or below 1750' MSL; climbing to our cleared altitude of 4000' on the Harys 4 SID; we experienced a Crossing Climb RA. The TCAS also demanded an increase rate of climb. Just before the RA; tower instructed us to call SOCAL departure. Passing 2200';we were clear of conflict. While we were in the middle of complying with the RA; the other aircraft became engaged with a conversation about us. Based on what I heard; the tower was explaining to that aircraft; that we must have seen him; because we maneuvered to avoid him. Truthfully; it was responding properly to the TCAS that caused our maneuver. I was busy making sure we were in compliance with the SID restrictions; and the pilot flying had just asked for heading and RNAV to be engaged. No sooner had I engaged the NAV modes; he was complying with the RA. This was no training RA; the fly to box was practically at the top of the attitude indicator. Since the tower frequency was occupied with the conversation previously described; and the TCAS reported clear of conflict; I checked in with SOCAL and told hime we had complied with a TCAS climb RA; and were clear of the contact passing 2200'. SOCAL gave us further climb instructions and vectors on course for the now modified SID. Then the SOCAL controller asked us if the tower had informed us of the traffic for his paperwork. The tower had not. Then he asked us if we had an RA; I reiterated that we had; and explained the RA to him. I never saw the intruding aircraft; the pilot flying never saw it either.He also told me that he was watching two yellow advisory targets of aircraft in the pattern. When out of nowhere the red TCAS RA box appeared right in front of us.

Second reporter narrative

We had just departed Van Nuys RWY 16R; and the PM alerted me that we had just passed the DER while monitoring our SID climb restrictions. I was observing two yellow traffic alerts that had materialized with a 'TRAFFIC' annunciation from the TCAS. Shortly thereafter; I noticed a third target that popped up as a red threat along with a 'Maintain Vertical Speed' RA that commanded a climb; which then immediately went to a 'Climb; crossing climb' and an increase in vertical speed. While this was happening; there was other radio chatter happening and a 'switch to departure' call from the tower. The PM checked in with departure and advised them that we had just finished responding to an RA. Departure asked if we had been notified of the traffic; which we hadn't.
