ACR X TKOF CLRNC: 'RWY HDG TO 2000 FT; SMA Y 5 MI N AT 2100 FT ON A PHOTO MISSION.' DURING CLBOUT OF 500 FT; WE NOTICED TFC AT 3 MI AT AN ALT OF 2000 FT COMING STRAIGHT AT US. AFTER SWITCHING OVER TO NORFOLK DEP WHO ADVISED US OF SMA Y TFC 12 O'CLOCK INDICATING 2000 FT; I ADVISED NORFOLK THAT WE WERE TURNING TO THE R TO AVOID TFC WITH AN RA. THE FO FLYING TURNED THE ACFT IMMEDIATELY TO A 35 DEG BANK TURN TO THE R AND INCREASED THE CLB TO THE SLOWEST SPD WE WERE ABLE. (THE ACFT WAS STILL AT TKOF PWR WITH THE FLAPS RETRACTED AND GEAR UP; BLEEDS WERE ON.) DURING THE TURN I SAW THE TFC IN OUR 10 O'CLOCK POS TURNING WITH US AND CLBING. I INTENSIFIED THE TURN TO A 45 DEG BANK AND AN INCREASE IN PITCH FOLLOWED BY A LITTLE MORE PWR. THE TCASII STRENGTHENED ITS DEMAND: 'INCREASE CLB.' THE CONFLICT CLRED ROLLING OUT ON A 120 DEG HDG AT 3000 FT. I ADVISED NORFOLK DEP OF THE 'NEAR MISS.' SHE ADVISED US THAT THE TFC HAS A VFR SQUAWK. I SWITCHED OVER TO PHF TWR ON THE OTHER RADIO AND ASKED IF HE WAS TALKING TO THE TFC; WHICH UPON TWR CONFIRMED THAT HE WAS TALKING TO HIM. I THEN ADVISED THE TWR THAT WE HAD A NEAR MISS. DURING CRUISE I ADVISED COMPANY FLT CTL OF THE INCIDENT AND ASKED IF THEY COULD CALL THE TWR AND ASKED WHAT HAPPENED. I TALKED TO TWR SUPVR WHO INSURED ME THAT HE WAS THE NEW SHIFT AND NOT AWARE OF ANY INCIDENT THAT MORNING. I GAVE HIM ALL THE INFO AND ADVISED THAT WITHOUT THE TCASII WE WOULD HAVE HAD A MIDAIR COLLISION. UPON HIS REQUEST I ADVISED HIM THAT I WOULD HAVE TO FILE A NASA; COMPANY INCIDENT AND TCASII RPT. I FEEL THAT WITHOUT THE TCASII WE DEFINITELY WOULD HAVE HAD A MIDAIR COLLISION INSIDE THE ATA OF THE NEWPORT NEWS ARPT. THE SIMPLEST SOLUTION WOULD HAVE BEEN TO ADVISE US TO TURN L XWIND ALT PERMITTED AND ADVISE NORFOLK PRIOR TO REACHING 2000 FT FOR TFC. THEN NOTHING WOULD HAVE HAPPENED.
