Narrative
I unintentionally conducted a brief flight over a small number of people due to misinterpreting the FAA's 'sustained flight' language relating to Operations Over People (OOP).On Day 0; I was operating a small UAS (DJI Air 3) for photography purposes under Part 107 rules. During a point-to-point transition flight between two open areas; I briefly crossed over several people who were standing in the transition path.At the time of the operation; I believed that because the transit was brief; one-time; and incidental to the point-to-point mission; it did not constitute 'sustained flight' over people based on FAA guidance describing sustained flight over an open-air assembly. I now understand that while brief transit may not qualify as sustained flight; it still qualifies as an 'operation over people'; which requires the aircraft to meet a Category 1; 2; or 4 approval (which mine does not); or the people must be participants; under a covered structure; or in a stationary vehicle.No injuries or property damage occurred; and the flight was otherwise stable and controlled.Error was discovered during editing of the footage and I decided to double check to make sure no regulations were missed or misunderstood.Contributing Factors:- Misinterpretation of FAA wording regarding 'sustained flight' vs. 'operations over people.'- Assumption that brief; incidental transit was permissible without a Category-qualified UAS.Corrective Actions Taken:- Reviewed Subpart D of Part 107 and FAA OOP category requirements to clarify that any flight directly over a person is considered an Operation Over People unless an exception applies.- Updated personal SOPs to explicitly prohibit overhead flight during transitions unless the area is cleared or a protected corridor is established.- Will avoid assumptions based on partial interpretations of FAA guidance and verify rule applicability more thoroughly.Additional Info:-Remote ID compliant: Yes-Weather: Cool air; clean visibility; cloudy day-People below were non-participants and not under cover.-No evasive maneuvers or loss of control occurred.-UAS NOTAM filed for the event by me
