Narrative
CLBING OUT OF N.S. ROOSEVELT ROADS PASSING THROUGH 3500 FT HAD COMMERCIAL AIRLINER PASS APPROX 25 FT ABOVE OUR FLT OF 2. ACFT WAS SEEN UPON MERGE OF FLT. DAY WAS VFR. AIR TFC APPEARED TO BE ENRTE TO ADJACENT ARPT OF FAJARDO FROM VIEQUES. ACFT ROUTINELY SHUTTLE BTWN THE 2 CIVIL ARPTS; BUT USUALLY UTILIZE THE 'FAJARDO TRANSITION' CHKING IN WITH N.S. ROOSEVELT ROADS FIELD PRIOR TO TRANSITIONING THROUGH THE ATA. HOWEVER; THIS ACFT WAS AT 3500 FT ABOVE CLASS D AIRSPACE AND THEREFORE DID NOT CHK IN WITH N.S. ROOSEVELT ROADS TWR. A LOA BINDING BOTH N.S. ROOSEVELT ROADS ARPT AND FAJARDO ARPT TO SPECIFIC CORRIDORS WOULD GREATLY REDUCE THE CHANCES OF CONFLICT AND POSSIBLE MIDAIR COLLISION BTWN DEPARTING AND TRANSITIONING ACFT. THE TRANSITING ACFT CROSSED OVERHEAD OUR FLT CAME FROM HDG 340 DEGS MAGNETIC. OUR FLT WAS HDG APPROX 060 DEGS IN A CLB AT CLOSEST POINT OF APCH. TRANSITIONING ACFT DID NOT APPEAR TO HAVE SEEN OUR FLT EVEN AFTER CLOSEST POINT OF APCH. SUPPLEMENTAL INFO FROM ACN 263488: PASS WAS UNOBSERVED BY LEAD. WINGMAN SAW THE CIVILIAN PASS FROM R TO L AT AN ESTIMATED SEPARATION OF 25 FT. CIVILIAN COMMERCIAL TFC IS USUALLY SHUTTLED IN AND OUT OF FAJARDO MUNICIPAL AT 1000-1500 FT. BETTER LOOKOUT MAY HAVE PREVENTED PROB; HOWEVER COMMERCIAL TFC TO AND FROM FAJARDO IS USUALLY CALLED BY TWR ON TKOF. NO COM FROM TWR INDICATES THAT POSSIBLY THE CARRIER WAS NOT TALKING TO NSRR TWR.
