Narrative
WE WERE ON THE DRAKE 6 SID OUT OF PHOENIX; CLBING TO FL240; ON THE PXR 336 DEG RADIAL TOWARD BANYO INTXN. ZAB CLRED US DIRECT TO HECTOR VOR; SO WE WERE IN A L CLBING TURN. PASSING THROUGH APPROX 12400 FT; WE RECEIVED A TA: A TARGET AT OUR 10 O'CLOCK POS; CONVERGING RAPIDLY; 1000 FT ABOVE. TCASII RESOLUTION ANNOUNCED 'STOP VERT CLB;' THEN ALMOST IMMEDIATELY ANNOUNCED; 'DSND; DSND.' WE INITIATED A DSCNT AT APPROX 12900 FT; AND THE TARGET PASSED DIRECTLY OVERHEAD (ACCORDING TO THE TCASII DISPLAY; BECAUSE WE WERE IMC THE ENTIRE TIME) AT A 90 DEG ANGLE; 400 FT VERT SEPARATION. I DO NOT BELIEVE THE TFC COULD HAVE BEEN MAINTAINING VFR CONDITIONS; WITH PROPER CLOUD CLRNC AT 13500 FT NEBOUND. WE IMMEDIATELY NOTIFIED ABQ THAT WE WERE REACTING TO A TCASII RESOLUTION ; AND ASKED FOR INFO ON THE TARGET ACFT. ZAB GAVE US THEIR PHONE NUMBER AND WHEN WE GOT TO BURBANK; CA; WE CALLED THE SUPVR. HE ADVISED US THAT RADAR SHOWED A CONVERGING VFR TARGET; SQUAWKING 1200; NEBOUND AT 13500 FT. THE CTLR FAILED TO SEE THE CONFLICT; AND FOR THAT; HE APOLOGIZED. HE FELT REAL UPSET ABOUT IT. WE ACCEPTED THE APOLOGY; AND ASKED THE SUPVR IF THEY COULD FIND OUT THE DEST OF THE TARGET ACFT. WE PLAN TO NOTIFY OUR AIR SAFETY COMMITTEE AND OUR ATC COMPANY COORDINATOR.
