RPTR CLAIMS TCASII RA TO CLB WAS RESPONDED TO 'SIMULTANEOUS' WITH ATC TA.
Narrative
DURING CRUISE AT 13000 FT MSL AROUND SOARS INTXN WHILE OPERATING UNDER IFR; WE WERE WITH ZNY ON FREQ 126.8. WE NEVER GOT A 'TFC; TFC;' BUT INSTEAD GOT AN 'RA.' ALMOST SIMULTANEOUSLY; CTR CALLED VFR TFC AT 1 O'CLOCK AT 12500 FT MSL; AND WE GOT A TCASII RA TO 'CLB; CLB; CLB.' THE CAPT (FLYING) INITIATED A CLB OF 1500 FPM TO 2000 FPM AS DIRECTED BY TCASII; I CALLED CTR TO ADVISE HIM OF OUR CLB DUE TO A TCASII COMMAND; HE ANGRILY TOLD US THAT THAT WAS QUOTE 'STUPID;' THAT HE HAD TOLD US OF THE VFR TFC AT 12500 FT; AND ASKED WHAT OUR ALT WAS. BY THEN WE HAD RECEIVED A 'CLR OF CONFLICT' ANNUNCIATION AND WERE RETURNING TO 13000 FT. I TOLD HIM WE HAD CLBED TO ABOUT 13600 FT AND WERE RETURNING TO 13000 FT. HE AGAIN ASKED WHY WE CLBED SINCE HE HAD CALLED THE TFC; I SAID BECAUSE WE NEVER SAW THE TFC AND THAT THE FAA (AS WELL AS OUR COMPANY) SAYS WE ARE TO RESPOND TO ALL RA'S -- HE THEN SAID HE PLANNED TO WRITE US UP. WE NEVER SAW THE TFC. WE DID EXACTLY WHAT THE FAA (AND OUR COMPANY) EXPECTS US TO DO. WE WERE FULLY COORDINATED AS A CREW. I PLAN TO FOLLOW THE NEXT RA. ALSO; THIS CTLR NEEDS TO GET WITH THE PROGRAM. TCASII IS HERE TO STAY.
