ANOTHER ACFT PLT BELIEVES RPTR CREATED A CONFLICT BY NOT OBTAINING AN IFR DEP FROM AN UNCTLED ARPT.
Narrative
DURING TAXI I CALLED CTAF ANNOUNCING 'ATX TXWY 1.' ALSO; MONITORING ZDC LISTENING FOR SOMEONE ON APCH AT HOLD SHORT LINE; I REQUESTED ON CTAF OF ANY ACFT ON APCH. NO RESPONSE. I CONTINUED WITH TKOF CHKLIST AND JUST BEFORE TKOF I ANNOUNCED DEP RWY 1 NWBOUND. AWOS RPTING 1100 FT RVR 7 MI VISIBILITY. I DEPARTED VFR TO MAINTAIN VFR ON A SHORT HOP TO RWI 28 MI NW OF PGV. ON CLBOUT OFF RWY 1 PGV; I STARTED A L TURN TO 310 DEGS NOTICING AN ACFT ON APCH TO RWY 19 ILS ABOUT 2 MI AWAY. I CONTINUED MY TURN TO DEPART THE PATTERN AND AVOID ANY CONFLICT; WHICH BY THE WAY I NEVER CONSIDERED THERE BEING ANY CONFLICT. AT THAT TIME I HEARD THE FIRST RADIO CALL ON CTAF OR WITH CTR. THE ACFT ANNOUNCED PATTERN ENTRY ON DOWNWIND FOR RWY 1 (WINDS WERE STRONG OUT OF THE N AND ILS ONLY ON RWY 19). ON CTAF THE ACFT ANNOUNCED HE HAD MY ACFT IN SIGHT AND ENTERING DOWNWIND FOR RWY 1. THAT WAS HIS FIRST CALL ON CTAF. THEN; THE PLT SWITCHED BACK TO ZDC AND ASKED THE CTLR IF HE HAD RELEASED ANYONE TO DEPART PGV -- CTLR SAID NO. PLT SAID TO CTLR THAT HE HAD AN ACFT TURN JUST IN FRONT OF HIM ON DEP; AND THEN HE SAID HE WAS GOING BACK TO CTAF. I'M NOT JUSTIFYING MY DEP IN MARGINAL CONDITIONS; I AM JUSTIFYING MY LEGAL RIGHTS TO HAVE DEPARTED GENERAL CTLED AIRSPACE UNDER THE CONDITIONS AT THAT TIME. AND TO EMPHASIZE THE IMPORTANCE AND AWARENESS OF PLT PROC WHEN NEGOTIATING IFR OR VFR IN SUCH AIRSPACE. IT IS MY BELIEF THAT THE OTHER ACFT HAD NOT ANTICIPATED THE POSSIBILITY OF THE OCCURRENCE. EVEN IF THE ACFT ONLY HAS 1 RADIO; THE CTLR WILL SWITCH YOU OVER TO CTAF AT; IF NOT BEFORE; THE OM. AND IF THE ACFT HAS 2 RADIOS; WELL YOU CAN MONITOR AND COMMUNICATE. CTAF 20 MI OUT. AFTER DEPARTING THE AREA; I CALLED THE ACFT CTAF AND ANNOUNCED THAT I HAD INDEED COMMUNICATED MY INTENTION AT PGV BEFORE AND DURING MY DEP; AND THAT I WISH WE HAD COMMUNICATED SO AS TO AVOID ANY SURPRISES. HIS RESPONSE WAS 'WE'LL TALK ABOUT IT LATER BUD!' I LEARNED MY LESSON FROM THIS OCCURRENCE. BUT I DON'T KNOW IF HE LEARNED ANYTHING.
