POSSIBLE NON COMPLIANCE WITH FARS BY FAA UNLIGHTED OBSTRUCTION ON ARPT.

Narrative

I WOULD LIKE TO RPT AN UNLIGHTED AND UNMARKED OBSTRUCTION TO AIR NAV THAT IS LOCATED AT THE COLUMBIA REGIONAL ARPT AT COLUMBIA; MO. IT IS A 70 FT TALL TWR THAT I HAVE RPTED TO THE FAA IN FEB/93 AND APR/93; BUT THERE HAS BEEN NO ACTION TAKEN TO RESOLVE THE PROB. I HAVE LEARNED THAT THE FAA DOESN'T LISTEN TO INDIVIDUALS; AND I FEEL THAT THEY ARE NOT THE LEAST CONCERNED WITH THE ABOVE HAZARD THAT I HAVE RPTED. I FEEL THERE IS CAUSE FOR CONCERN AS THERE IS NOT ONLY THE POTENTIAL FOR A FATAL ACCIDENT; THERE IS ALSO A POTENTIAL FOR A SERIOUS DISRUPTION TO FLT SVCS AS THIS TWR IS IMMEDIATELY ADJACENT TO THE COLUMBIA AUTOMATED FSS; WHICH PROVIDES FLT SVCS OVER THE ENTIRE STATE OF MISSOURI; AND ALSO SOUTHERN ILLINOIS. THE TWR HAS BEEN IN PLACE FOR ABOUT 5 YRS. FAR 77.23 STATES THAT AN OBJECT WOULD BE AN OBSTRUCTION TO AIR NAV IF IT IS OF GREATER HT THAN ANY CIVIL ARPT IMAGINARY SURFACE ESTABLISHED UNDER FAR 77.25. I HAVE DETERMINED THAT THIS TWR EXCEEDS THIS IMAGINARY SURFACE BY APPROX 6-10 FT. THEREFORE; IT WOULD BE CONSIDERED AN OBSTRUCTION TO AIR NAV; AND IS IN VIOLATION OF FARS. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: RPTR STATED THE TWR IS THE FSS MICROWAVE COM TWR. RPTR NOTIFIED KANSAS CITY FSDO ABOUT THE UNLIGHTED OBSTRUCTION WITH NO ACTION FOR 2 YRS.
