Narrative
ACR X APCHING GUA VOR LEVEL FL330 ASSIGNED; SIGHTED THE CONTRAIL OF AN ACFT APCHING FROM THE OPPOSITE DIRECTION THAT APPEARED TO BE AT OUR ALT. AT ABOUT 5 MI SEPARATION; I BEGAN A L TURN TO PROVIDE SEPARATION; AS THE APCHING ACFT WAS COMING FROM ABOUT 11 O'CLOCK. AS THE TURN WAS INITIATED; WE RECEIVED A TCASII ALERT TO CLB. I CLBED THE ACFT TO FL338 AND THE OTHER ACFT PASSED BELOW AND SLIGHTLY TO THE R OF US. IT WAS ACR Y MD88. AT TIME OF PASSING; TCASII INDICATED AN ALT DIFFERENCE OF 400 FT. THE INCIDENT WAS IMMEDIATELY RPTED TO EZA CTL; BUT WE RECEIVED NO INFO FROM THE CTLR; WHO WAS ENGAGED IN A CONTINUOUS CONVERSATION WITH Y PLT. WE REQUESTED THAT THEIR CONVERSATION BE CONDUCTED IN ENGLISH SO WE COULD KNOW WHAT WAS GOING ON; BUT WE WERE IGNORED; AND THEIR CONVERSATION CONTINUED IN SPANISH. LATER THAT EVENING; I WAS CONTACTED AT MY HOTEL BY CAPT X; WHO IDENTED HIMSELF AS A CHIEF PLT WITH ACR Y. HE STATED THAT HE WAS INVESTIGATING THE INCIDENT AND THAT THE INVOLVED CTLR ASSUMED RESPONSIBILITY FOR THE INCIDENT. SUPPLEMENTAL INFO FROM ACN 305882: APCHING GUA AT FL330; SAW ACFT COMING FROM OPPOSITE DIRECTION. TCASII SAID AT OUR ALT. GOT THE RA; CAPT DID THE CLB. MISSED BY 400 FT. LATERAL SEPARATION OF QUARTER MILE. NOTIFIED ATC OF COMPLYING WITH RA. ATC DID NOT RESPOND. CALLED BTWN 5 AND 10 TIMES WITHOUT RESPONSE. HEARD OTHER ACFT CONVERSING WITH ATC AFTER WE PASSED. I ASKED THEM TO SPEAK IN ENGLISH. NO RESPONSE. NEVER DID GET THEM TO ADDRESS THE NEAR MISS. WE WERE ON 125.6; EZEIZA CTL; THE NEXT TIME THEY SPOKE TO US THEY SWITCHED US TO BAIRES CTL; 124.9. TCASII WORKED GREAT; AS ADVERTISED. BIGGEST COMPLAINT IS SPANISH SPOKEN WHEN ENGLISH SHOULD BE.
