ACFT #2 DEPARTED EWK ARPT; MADE L TURN OUT; THEN APPEARED TO ENTER L DOWNWIND. ACFT #1 DEPARTED RWY 17 EWK BEHIND ACFT #2. THEN MADE A STRAIGHT OUT DEP. ACFT #1 THEN CONTACTED ICT APCH CTL AND REQUESTED VECTORS FOR THE ILS RWY 17 EWK. ICT APCH CALLED ACFT #2 AS TFC FOR ACFT #1. ACFT #1 ACKNOWLEDGED TFC IN SIGHT. THEN RECEIVED A VECTOR TO THE NE FOR THE APCH. WHILE TURNING; ACFT #1 LOST SIGHT OF ACFT #2. ACFT #1 CONTACTED ICT APCH AND REQUESTED POS OF ACFT #2. APCH CALLED TFC NO FACTOR. THIS IS WHAT ACTUALLY HAPPENED: ACFT #2 TURNED S INSTEAD OF N AFTER MAKING A L XWIND LEG. ACFT #1 WHILE ON A VECTOR FROM APCH PASSED OVER ACFT #2 CLRING IT BY 200 FT VERT. ALL THIS IS ACCORDING TO AN FAA EXAMINER WHO WAS RIDING IN THE REAR SEAT OF ACFT #1. THE PLT OF ACFT #1 WAS WEARING IFR TRAINING HOOD AND I WAS RIDING R SEAT AS CHK AIRMAN CANDIDATE. THE FAA EXAMINER SAW THE IMPERATIVE DANGER AND DID NOTHING TO WARN ME OR THE PLT THUS RESULTING IN AN NMAC. APCH CTL RPTED ACFT #2 AT 3700 FT AND ACFT #1 WAS CLBING THROUGH 3450 FT AT TIME OF INCIDENT. HOWEVER; ACCORDING TO THE FAA EXAMINER WE PASSED OVER ACFT #2 AT 200 FT VERT SEPARATION. MY EVASIVE ACTION WAS CALLING ICT APCH AND REQUESTING POS OF ACFT #2. I NEVER DID SEE THIS TAKE PLACE.
