A CTR CTLR CLAIMS THAT A BE90 PLT WILL CANCEL IFR CLRNC WHEN ISSUED A RERTE AROUND MOA AIRSPACE AND PROCEED INTO THE AIRSPACE. ALLEGEDLY; THE RPTR HAS WITNESSED SEVERAL CLOSE CALLS BTWN MIL ACFT AND THE BE90 WHILE IN THE MOA.

Narrative

I AM TRAINING ON MY LAST SECTOR AT ZME. THIS HAS PUT ME IN THE UNIQUE POS OF BEING ON THE SAME SECTOR 3 - 5 1/2 HRS A DAY; 2-4 DAYS A WK. I HAVE NOTICED A TREND WITH A CERTAIN ACFT; ACFT X (A BE90). NAS MCCAIN AT MERIDIAN IS FLYING FULL TRAINING SCHEDULES WITH A4; T45 AND T2 ACFT. THE MERIDIAN W MOA IS IN CONSTANT USE. SEVERAL ACFT ON IFR FLT PLANS ARE REROUTED AND THEY DO NOT COMPLAIN. ACFT X TAKES A DIFFERENT APCH. WHEN THE PLT IS ISSUED A RERTE OR DSCNT TO GO UNDERNEATH THE MERIDIAN W MOA; HE WILL CANCEL IFR AND GO THROUGH THE MOA. SOMETIMES HE WILL GET FLT FOLLOWING OR WAIT UNTIL HE IS INSIDE OF THE MOA AND REQUEST VFR FLT FOLLOWING. ON MORE THAN 2 OCCASIONS I HAVE WITNESSED NMAC'S BTWN ACFT X AND A4 ACFT; AND ACFT X AND T2 ACFT. IF THE RADAR CTLR IS TOO BUSY; TFC WILL NOT BE ISSUED TO THE VFR ACFT. ALSO; THE A4 AND T2 DO NOT HAVE TCASII AND ARE CONDUCTING AERIAL COMBAT MANEUVERING. I HAVE WITNESSED THE XPONDER BEACONS FROM THE MIL MERGE WITH ACFT X AND NO ACFT HAVE THE OTHER IN SIGHT AT MORE THAN 500 KTS CLOSURE. WHENEVER THE PLT OF ACFT X IS RECEIVING VFR; HE ALWAYS RECEIVES A WARNING ABOUT THE MIL FLYING. THE PLT APPEARS UNIMPRESSED AND SOMEWHAT UNCARING ABOUT IT YET HE HAS NEARLY DIED TWICE. BECAUSE OF SOME QUICK REACTING MIL PLTS HE WAS VERY LUCKY. I FEEL IF AN ACCIDENT WERE TO HAPPEN WITH THIS ACFT; THE FAA WOULD BE ON THE RECEIVING END OF A LAWSUIT. THE ATTITUDE OF THIS PLT APPEARS TO BE THAT HE OWNS THE SKY. HE DOESN'T APPEAR TO UNDERSTAND THAT TA'S ARE ON A TIME PERMITTING BASIS.
