RPTR CLAIMS THE ROUTING HE IS GIVEN INTO JFK IS OUTSIDE THE CLASS B AIRSPACE AND IS A TFC DANGER BECAUSE OF A HIGH DENSITY OF VFR TFC NOT REQUIRED TO HAVE OPERATING XPONDERS. IT ALSO CAUSES A HIGH FUEL BURN BECAUSE OF LOW ALTS FLOWN.

Narrative

I AM RPTING WHAT I BELIEVE IS A VERY DANGEROUS SIT THAT HAS DEVELOPED IN THE DAILY OP OF NEW YORK APCH INTO THE JFK ARPT. WHILE FLYING THE PAWLING 2 ARR (PWL.PWL2) MY FLTS ENCOUNTER RA'S FREQUENTLY WHEN S OF LOVES INTXN; AND ESPECIALLY IN THE BDR AREA. THE STAR HAS ACFT XING LOVES INTXN AT 6000 FT AND THEN ATC KEEPS ACFT AT 4000 FT OVER BDR. MY ACFT INDICATES 250 KTS AT THIS ALT AND THESE LOW XING RESTRS SEEM INAPPROPRIATE. IN ADDITION; DURING VMC; ACFT NOT UNDER IFR FLT PLANS ARE NOT REQUIRED TO HAVE OPERATING XPONDERS IN THIS AREA SINCE IT IS OUTSIDE THE NEW YORK CLASS B 30 MI VEIL! MY COMPANY CONTINUES TO FILE THE HIGH ALT STAR OVER LENDY (LVZ;LENDY4) BUT ATC SIMPLY WON'T LET US DO IT. IN ADDITION TO THE TFC DANGER OF THE PAWLING STAR; OUR FUEL BURN IS UNREASONABLY HIGH DUE TO THE LOW ALTS; AND CAN ALSO POSE OPERATIONAL PROBS DUE TO DELAYS (IE; DIVERSION DUE TO LOW FUEL). I HAVE NO DOUBT THAT A MIDAIR COLLISION WILL EVENTUALLY OCCUR ON THE PAWLING ARR AND WILL INVOLVE AN ACR ACFT. IN MY EXPERIENCE WHILE FLYING THIS ARR; IT APPEARS THAT NO AMOUNT OF VIGILANCE WILL PROTECT MY PAX AND CREW BECAUSE OF THE HIGH TFC DENSITY AT THESE ALTS; IN THIS AREA. LET US NOT WAIT FOR A TRAGEDY FOR ATC TO FINALLY REVISE THIS ARR TO MUCH SLOWER ACFT.
