B737 AND GULFSTREAM HAD NMAC IN ZTL CLASS E AIRSPACE.

Narrative

WE WERE ON AN IFR FLT PLAN FLYING THE BROOK 2 ARR INTO GSO CLRED TO CROSS THE 35 MI FIX ON THE BROOK 2 AT 11000 FT. AT 13200 FT AND APPROX 42-45 MI OUT; ANOTHER ACFT SHOWED UP ON TCASII CLBING TOWARD ME AND I ASKED THE CTLR WHAT HE WANTED ME TO DO. HE SAID I 'MIGHT WANT TO LEVEL OFF AT 13000 FT.' SO I DID. THE VFR GULFSTREAM CONTINUED TO CLB STRAIGHT AT ME. THE GULFSTREAM PLT VERIFIED WITH THE CTLR THAT I WAS GOING TO LEVEL OFF AT 13000 FT. AT ABOUT 1 1/2 MI SEPARATION AND 200 FT VERT SEPARATION; I COULD SEE THAT THE GULFSTREAM INTENDED TO CONTINUE HIS CLB THROUGH 13000 FT; SO I ADDED PWR AND CLBED. I WAS AT 13600 FT WHEN THE GULFSTREAM PASSED DIRECTLY UNDER ME WITH 400 FT CLRNC. I WAS OPERATING ACR ABCD FLYING CVG DIRECT GSO AND THIS OCCURRED AT XA55 ON FEB/XA/00. THE CTLR DID NOT ISSUE ANY AVOIDANCE VECTOR OR ALT CHANGE TO ME (NEGLIGENCE) AND THE VFR ACFT SAW; BUT DID NOT AVOID ME (NO SITUATIONAL AWARENESS). WHILE I CAN'T UNDERSTAND WHY THINGS LIKE THIS HAPPEN; THEY DO. WHAT WAS MOST DISTURBING TO ME WAS THE CTLR'S INSISTENCE THAT I MAKE THE 11000 FT XING RESTR. IF THE 2 OF US HAD COLLIDED (AND IT WAS CLOSE) HE'D HAVE A LITTLE MORE TO WORRY ABOUT THAN SOME RESTR ON A PIECE OF PAPER.
