TWR/APCH CTLR BELIEVES THAT THE ACT CLASS D AIRSPACE SHOULD BE MADE CLASS C DUE TO A VFR PIPER; IN MARGINAL VFR CONDITION; CAUSING A POTENTIAL CONFLICT WITH AN IFR CESSNA 152 MAKING AN NDB APCH.

Narrative

PA32 CALLED FOR DEP FROM ACT; EBOUND; VFR AND PURPOSELY STATED; 'I DO NOT WANT FLT FOLLOWING.' HE DEPARTED. C152 WAS PRACTICING AN NDB RWY 35R APCH INTO CNW; ABOUT 10 MI SE OF ACT. ROBINSON (ROB) IS THE FAF FOR THIS APCH. THE WACO APCH CTLR CALLED ME ON THE LAND LINE AND ASKED WHO IS THE VFR SE OF WACO AT 3500 FT. BY THIS TIME THE PA32 WAS OUTSIDE THE CLASS D. THE C152 RPTED IMC AT 3000 FT AND A MOONEY; ABOUT 10 MI NE OF THIS ACTION; RPTED IMC AT 4000 FT. THERE WERE GAPS THE PA32 CLBED THROUGH. I CALLED PA32 ON FREQ TO SEE IF HE WAS THERE. THE PA32 SAID HE WAS BTWN A SCATTERED LAYER BELOW AND OVCST ABOVE. A FEW SECONDS LATER; THE PA32 STARTED DSNDING INTO THE PATH OF THE C152. APCH ISSUED TFC ALERT TO C152 AND I ISSUED ONE TO THE PA32. THE PA32 SAID HE ENCOUNTERED A CLOUD AND WAS MAKING A 180 DEG TURN AND DSNDING TO GET BELOW. FAR PART 91.155 SAYS 2000 FT HORIZ; 500 FT BELOW; AND 1000 FT ABOVE. I BELIEVE THIS WAS QUESTIONABLE BUT CANNOT BE PROVED. MY POINT BEING THAT WACO NEEDS A CLASS C AIRSPACE. WITH A CLASS C; THE PA32 WOULD HAVE BEEN TALKING TO APCH. THIS HAS BEEN AN ISSUE SINCE I HAVE BEEN AT WACO IN 4 1/2 YRS. I HAVE WRITTEN CONGRESSMAN AND FILLED OUT A FEW NASA FORMS. MAY OCCURRENCES LIKE THIS HAVE HAPPENED AND I FEEL SAFETY IS BEING COMPROMISED BECAUSE WE CAN'T HAVE A CLASS C. WE NEED ONE AT WACO.
