FLC OF A CARGO MD11 TOOK EVASIVE ACTION IN RESPONSE TO A TCASII RA CAUSED BY A FOREIGN GOV MIL F16. THE FO DEP CTL HAS NO CTL OVER FOREIGN MIL OPS. THEREFORE; CTLR DID TURN AND LEVELOFF RPTR'S ACFT BUT STATED OVER THE RADIO THAT IT WAS A FALSE TARGET.

Narrative

I WAS THE PIC AND PNF OF ACR X FLT X ON MAY/FRI/00. DURING IMC DEP CLB FROM SEOUL S KOREA (RKSS) PASSING FL145 ON AIRWAY B576 BTWN OSN VOR AND NAMJA INTXN; A TCASII TA WAS DISPLAYED ON OUR PRIMARY FLT DISPLAYS. WE WERE FLYING AN MD11F. THE TA INDICATED A DSNDING TARGET 3800 FT ABOVE OUR CLBING ALT AT OUR 12 O'CLOCK POS; SLIGHTLY R OF OUR TRACK. I INSTRUCTED THE FO; WHO WAS FLYING THE ACFT; TO REDUCE HIS RATE OF CLB. ALMOST IMMEDIATELY WITH HIS REACTION TO MY COMMAND; SEOUL DEP CTL CALLED WITH INSTRUCTIONS TO 'LEVEL AT FL160 (WE WERE NOW ABOVE FL155); TFC 12 O'CLOCK POS; 2000 FT ABOVE' (APPROX STATEMENT). DUE TO THE RAPID RATE OF HEAD-ON CLOSURE DISPLAYED BY TCASII; I INSTRUCTED THE FO TO TURN L. ALMOST SIMULTANEOUSLY WE RECEIVED AN RA WITH A COMMAND TO DSND AND A CALL FROM THE ATC CTLR TO 'TURN L TO 150 DEGS.' WE THEN RECEIVED A TCASII COMMAND TO 'CLB' WHICH WE DID. ATC MADE 1 OR 2 CALLS CONCERNING OUR HEADING (WE HAD NOT YET ATTAINED 150 DEGS) WHICH WERE NOT ANSWERED DUE TO HIGH WORKLOAD AND STRESS. THE TCASII RA CEASED AND ATC GAVE US A VECTOR BACK TO B-576 AND CLRNC TO CLB TO FL350. I ASKED ATC WHAT THE OTHER TFC WAS AND WAS TOLD THAT IT WAS A 'FALSE TARGET.' I REPLIED THAT I WAS GOING TO FILE A NEAR MISS RPT AND AGAIN QUERIED THEM ABOUT THE TFC. AFTER A SERIES OF SHORT RADIO EXCHANGES; WE WERE INFORMED THAT THE OPPOSING TFC WAS AN FOREIGN MIL F16; CALL SIGN XXX. AT NO TIME DID WE HEAR ANY RADIO CALLS BTWN ATC AND THE F16. CIVILIAN ATC APPARENTLY HAS NO CTL OVER FOREIGN MIL TFC TRANSITING THE SEOUL AREA. B-576 IS THE MAJOR AIRWAY FOR TFC ENTERING/EXITING SEOUL TO/FROM SE ASIA. CONFLICTS SUCH AS THIS ARE ON-GOING. IN YRS PAST; OSAN AIR BASE ATC CTLED ALL FLTS WITHIN THE SEOUL AREA. SINCE THIS HAS STOPPED EVENTS SUCH AS THIS ARE COMMON. THE RESULT INEVITABLY WILL BE LOSS OF LIFE DUE TO MIDAIR COLLISION. THE UNITED STATES DEPT OF STATE AND/OR ICAO MUST RECTIFY THIS SIT.
