NMAC BTWN AN IFR TRINIDAD TB20; VFR ON TOP AT 9000 FT; AND A SINGLE ENG LOW WING ACFT COMING OUT OF THE UNDERCAST MAKING AN EVASIVE ACTION CLBING TURN.

Narrative

ON THE MORNING OF MAR/XA/01; I WAS FLYING TB-20 ON AN IFR FLT PLAN ENRTE FROM STUART; FL; TO DUBLIN; GA. I WAS LEVEL AT 9000 FT MSL ABOVE A SOLID TO BROKEN LAYER OF CLOUD WITH TOPS THAT VARIED FROM ABOUT 8500-9000 FT MSL. SHORTLY BEFORE HANDING ME OFF TO JAX APCH; DAB APCH GAVE ME A HDG OF 010 DEGS FOR TFC AVOIDANCE. JAX THEN GAVE ME A CLRNC DIRECT DUBLIN. I HAD COMPLETED THE TURN WHEN SUDDENLY ANOTHER ACFT BURST THROUGH THE CLOUDS DIRECTLY IN FRONT OF ME AND IMMEDIATELY INITIATED A L BANK AND CLB. THE OTHER ACFT PASSED ABOUT 50 FT ABOVE AND 150 FT TO THE R. IT WAS A SINGLE ENG; LOW WING; RETRACTABLE GEAR ACFT; PROBABLY 4 PLACE. THE COLOR SCHEME OF THE FUSELAGE WAS SIMILAR TO THAT OF RECENT COMMANDER 114'S OR MOONEY'S. I RPTED THE INCIDENT TO THE CTLR WHO APOLOGIZED TO ME FOR NOT HAVING GIVEN ME; IN HIS WORDS 'A HEADS UP.' HE SAID THE OTHER ACFT HAD BEEN OPERATING IN THE AREA FOR A WHILE. I THINK THE CTLR SERIOUSLY ERRED IN NOT ALERTING ME TO THE POTENTIAL CONVERGENCE OF MY FLT PATH WITH THAT OF ANOTHER ACFT IN THE AREA. THE CTLR WAS OBVIOUSLY AWARE OF THE OTHER ACFT; BUT APPARENTLY NOT IN COM WITH IT. THE OTHER PLT WAS PRESUMABLY FLYING VFR IN IFR CONDITION.
