A C182 PVT PLT DISCOVERED HIS INST INSTRUCTOR WAS NOT QUALIFIED; DUE TO AN INVALID MEDICAL CERTIFICATE.
Narrative
ON THE DATES NOTED; I WAS RECEIVING INST FLT TRAINING FROM MY INSTRUCTOR. PART OF THE 2 FLTS IN QUESTION INCLUDED TIME WHEN I WAS WEARING VIEW OBSTRUCTION DEVICES; IE; UNDER THE HOOD. MY INSTRUCTOR SERVED AS SAFETY PLT DURING THIS PHASE OF INSTRUCTION. WITHIN THE LAST SEVERAL MONTHS MY INSTRUCTOR HAD A PACE MAKER INSERTED AND AT THE TIME OF THESE 2 FLTS DID NOT HAVE A VALID MEDICAL. THE 2 FLTS WERE IN UNCROWDED VFR AND COMPRISED PRACTICE GPS APCHS NEAR I69; ISZ-HAO. THE FLTS WERE UNEVENTFUL. I MADE THE LNDGS UNDER VFR AND FULL VISION. THE FOLLOWING WK I CONTACTED MY INSTRUCTOR ABOUT ANOTHER LESSON AND WAS TOLD HE COULD NO LONGER ACT AS A SAFETY PLT BECAUSE OF THE LACK OF A CURRENT MEDICAL. THIS WAS THE FIRST TIME WE BOTH REALIZED THIS. WE AGREED HE COULD NO LONGER INSTRUCT ME UNDER THE HOOD. I CONTACTED A LAWYER TO CONFIRM OUR DECISION. SINCE THAT TIME I HAVE SOUGHT A DIFFERENT CFII AND DO NOT INTEND TO USE MY PREVIOUS CFII UNTIL HE IS FULLY CERTIFIED. I WILL ALSO INSURE THAT THE NEW INSTRUCTOR MEETS ALL THE FAR REQUIREMENTS. MY OLD CFII IS A VERY EXPERIENCED CFII AND AT NO TIME DURING THE FLTS IN QUESTION WAS THERE A SAFETY ISSUE. AT ALL TIMES WHILE I WAS UNDER THE HOOD; MY CFII WAS WATCHING FOR OTHER ACFT AND WAS READY AND ABLE TO ASSUME CTL OF THE ACFT; IF IT WOULD HAVE BEEN NECESSARY TO DO SO. THIS SIT WILL NOT OCCUR AGAIN SINCE I WILL INSURE ANY SAFETY PLT IS FULLY QUALIFIED TO SERVE IN THAT CAPACITY.
