AEST PLT DEPS VFR FROM SDL TO OBTAIN VFR FLT FOLLOWING AND IS ADVISED BY SCT DEP TO RETURN TO LAND BECAUSE OF NATIONAL NOTAM RESTRING VFR FLT.

Narrative

ON SUNDAY AT XA30 LOCAL; I FILED AN IFR FLT PLAN FOR KMYF FROM KSDL WITH RENO FLT CENTER (800 WX BRIEF) BY CELL PHONE. I CONTACTED ATIS AND WAS TOLD THE TWR WAS CLOSED AND TO CONTACT DEP ON ONE OF THEIR FREQUENCIES. NEITHER OF THEIR FREQS COULD BE RAISED FROM THE GND; SO I DEPARTED AND CONTACTED DEP AT APPROX 400 FT AGL; 0.5 MILES W OF THE ARPT. I WAS TOLD BY DEP THAT I WAS IN VIOLATION OF THE RECENT CLASS B VFR NOTAM AND TO LAND IMMEDIATELY. I RETURNED TO SDL. I CONTACTED THE LOCAL FSS AND WAS GIVEN A DEP AND VOID TIME AND DEPARTED WITH NO PROB. 1) I DEFINITELY VIOLATED THE CLASS B NOTAM. 2) THE LOCAL ATIS SHOULD NOT HAVE SAID TO CONTACT DEP FROM THE GND; BECAUSE THE LOCAL KNOWLEDGE WAS THAT THAT WAS IMPOSSIBLE. 3) I WOULD ALSO SUGGEST THE ATIS SAY THAT DEP COULD NOT BE REACHED FROM THE GND AND THAT A VOID TIME WAS NECESSARY FOR IFR FLT. WHEN I CALLED WX BRIEF TO FILE MY FLT PLAN; MY CELL PHONE CONTACTED RENO. IF I HAD TALKED TO THE LOCAL BRIEFER; I AM SURE I WOULD HAVE BEEN GIVEN A VOID TIME. SINCE I WASN'T; I INCORRECTLY ASSUMED THAT DEPARTING VFR AND OPENING IN THE AIR WASN'T IN VIOLATION OF THE NOTAM.
