COM PROBS AND TFC CONFLICT DURING DEP FROM EWR; NJ.

Narrative

I WAS THE CAPT ON A NIGHT FLT OUT OF EWR; NJ. WE WERE GIVEN A TKOF CLRNC ON RWY 22R WITH A DEP FREQ CHANGE. TKOF AND INITIAL DEP NORMAL. SEVERAL ATTEMPTS ON THE NEW DEP FREQ WERE MADE WITHOUT LUCK. HAD TO RE-ESTABLISH COM WITH EWR TWR FOR A SECOND NEW DEP FREQ. ESTABLISHED ON THE EWR 6 SID 10-12 NM S OF EWR; WE FINALLY GOT HOLD OF EWR DEP. WE ARE GIVEN A CLRNC TO 'R TURN DIRECT SOLBERG; CLB AND MAINTAIN 11000 FT.' AFTER ESTABLISHED SOLBERG; I SPOTTED AT MY 12 O'CLOCK POS TFC WHILE AT 7000-7500 FT. I INITIATED AN EXPEDITED CLB ON THE ASSIGNED RTE TO THE ASSIGNED ALT OF 11000 FT TO ASSIST IN THE SEPARATION FROM THE TFC. DEP CTL ASKED US IF OUR XPONDER WAS ON AND DID WE HAVE THE TFC. WE SAID YES TO BOTH QUESTIONS. DEP CTL ADVISED CREW TO CONTACT PHONE NUMBER UPON ARR. NOTE: THERE WAS NO TCASII WARNING UNTIL AFTER I WAS IN AN EXPEDITED CLB AND THEN THE ADVISORY WAS ONLY 'TFC; TFC.' SUPPLEMENTAL INFO FROM ACN 528416: DURING THE NEXT 3 FREQ CHANGES THE PREVIOUS FREQ HAD TO BE CONTACTED IN ORDER TO OBTAIN NEW FREQ TO ESTABLISH CONTACT WITH ATC CTR SECTORS.
