AN EMBRAER 140 WAS FLOWN IN NON COMPLIANCE WITH R GEAR DOOR AND WHEEL FAIRING REMOVED AND DEFERRED IN CONFLICT WITH THE CDL.

Narrative

AT XA14; ACR X MAINT OPS CTLR ISSUED 2 CDL'S ON THE MAIN LNDG GEAR SYS. THE DISPATCHER ACKNOWLEDGED THIS AND GAVE HIS INITIALS. HE THEN RESTRICTED THE ACFT (AN EMB 140) TO 250 KIAS IN ACCORDANCE WITH THE INSTRUCTIONS IN BOTH CDL'S. WHEN I ARRIVED FOR WORK AT XB00; THIS ACFT WAS ASSIGNED TO MY FLT ZZZ-ZZZ1. I DID THE RELEASE AND QUERIED MAINT OPS CTLR ABOUT THE 2 CDL'S BEING ISSUED ON THE SAME SYS. MAINT OPS CTLR ASSURED ME THE 2 COMPONENTS WERE SEPARATE SUBSYSTEMS AND WERE LEGAL TO BE DISPATCHED. I ENSURED THE 250 KIAS SPD RESTRS HAD BEEN COMPLIED WITH; AND I DISPATCHED THE FLT ON AN IFR FLT PLAN. THE WX WAS VMC AND THE FLT TO ZZZ1 WAS UNEVENTFUL. I WAS NOTIFIED ON FEB/FRI/03 THAT MAINT HAD GNDED THE ACFT SOMETIME ON FEB/FRI/03 BECAUSE THE LEGALITY OF HAVING ISSUED THE 2 CDL'S ON THE SAME SYS WAS IN QUESTION. THE ACR X DIRECTOR OF SYS OPS CTL SUGGESTED I FILE THIS NASA RPT. SINCE THIS OCCURRENCE; ACR X MAINT OPS CTLR HAS CONTACTED THE ACFT MANUFACTURER AND NOW HAS A LETTER THAT VERIFIES THE LANGUAGE IN THE FRONT OF THE CDL SECTION OF OUR COMPANY'S MEL'S FOR THE EMBRAER 135/140 IS IN ERROR AND CORRECTS/CLARIFIES TO ALLOW FOR SEPARATE SUBSYSTEMS UNDER A SINGLE SYS IN THE CDL'S TO BE ISSUED AND FLOWN LEGALLY AS HAPPENED ON THIS FLT.
