BE-1900 FLT CREW RELAYS CONCERN WITH VISUAL SEPARATION APPLICATION DURING CLBOUT FROM CLT ARPT.

Narrative

DURING CLBOUT; INSTRUCTIONS WERE RECEIVED FROM ATC TO CLB TO 9000 FT AND TO MAINTAIN VISUAL SEPARATION FROM A DEHAVILAND DASH 8 THAT WE WERE OVERTAKING. WE COMPLIED; AND AS WE OVERTOOK AND PASSED ABOVE THE DASH 8; THE FLT CREW RPTED TO ATC THAT THEY WERE RECEIVING A TCASII ADVISORY AND WOULD HAVE TO TAKE EVASIVE ACTION IF IT CONTINUED. ATC ADVISED THEM THAT THEY WERE BEING OVERTAKEN AND THAT THE ACFT HAD THEM IN SIGHT AND WAS MAINTAINING VISUAL SEPARATION. THE TCASII ADVISORY APPARENTLY CONTINUED AND THE FLT CREW OF THE DASH 8 BECAME SOMEWHAT AGITATED AND ASKED FOR A PHONE NUMBER TO CALL AND DISCUSS THE SIT UPON LNDG. I ALSO COPIED THE PHONE NUMBER AND LATER PHONED THE SUPVR OF CHARLOTTE TRACON. HE INDICATED THAT WE HAD ACTED PROPERLY SO FAR AS HE WAS CONCERNED AND THAT HE HAD REVIEWED THE OCCURRENCE WITH THE CTLR. ALTHOUGH WE BELIEVED THAT OUR CLB WAS WITHIN REGS; I STILL FIND THE SIT DISTURBING. IN THE FUTURE; I PLAN TO ASK FOR A REVISED HEADING OR ALT WHEN IT APPEARS THAT MY FLT WILL PASS CLOSE ENOUGH TO CAUSE A TCASII ALERT; ESPECIALLY IN SITS WHEN THE POS OF THE 2 ACFT WILL MAKE VISUAL IDENT DIFFICULT FOR ONE OF THEM.
