Narrative

FLT FROM MSN TO UES (49 NM); IFR. CONDITIONS IN MSN WERE 2000 FT AND 7 MI; IN UES CONDITIONS WERE 600 FT AND 3 MI IN HAZE; LIGHT TO MODERATE ICING IN CLOUDS. WINDS AT UES 030 DEGS AT 6 KTS. CLRED FOR ILS 10 BY MKE APCH. INFORMED THAT RWY 10 WAS CLOSED DUE TO ACFT ON RWY. REQUESTED AND GRANTED ILS 10 CIRCLE TO RWY 36. COMPLETED ILS 10 TO 600 FT AGL. ARPT IN SIGHT; CIRCLED TO RWY 36. DURING CIRCLE; I LOST SIGHT OF THE ARPT. I CALLED A MISSED APCH AND WAS HANDED BACK TO MKE APCH. REQUESTED A SECOND ILS 10; CIRCLE TO RWY 36. DURING VECTOR; I HEARD 2 ACFT DEPARTING RWY 28. I ASKED TWR WHERE THE OBSTRUCTING ACFT WAS AND THEY REPLIED; 'THE APCH END OF RWY 28.' TUG WAS IN PLACE TO TOW ACFT OFF THE END OF RWY 10 (RWY 28). WHEN I COMPLETED THE ILS 10 APCH; I COULD SEE THE ACFT WAS CLR OF THE FAR END OF RWY 10. TWR HAD NOT YET OPENED THE RWY. I REQUESTED A LAHSO CLRNC. TWR SAID THEY COULD NOT GRANT ONE. THEY CLRED ME TO CIRCLE AND LAND ON RWY 36. I DID NOT WANT TO CIRCLE IN MARGINAL CONDITIONS WITH ICE. I LANDED ON RWY 10 AND STOPPED WITHIN 2000 FT ON A 6000 FT RWY. AS I TOUCHED DOWN; TWR CLRED THE MOONEY BEHIND ME TO LAND ON RWY 10! OBVIOUSLY; RWY 10 WAS THEN OPEN! I BELIEVE TWR SHOULD HAVE CLRED ME TO LAND ON RWY 10; HOLD SHORT OF RWY 36. IT WAS MUCH SAFER TO LAND ON RWY 10 THAN TO CIRCLE IN LOW CONDITIONS TO RWY 36.
