NMAC WITH ACR AT CRUISE ALT.

Narrative

APCHING LA TCA AND SPEAKING WITH APCH WE WERE TO TRANSITION TCA'S FAR WEST CORNER AT 8500'. LA APCH SAID 'MLG AT 1 TO 2 O'CLOCK 5 MILES. HE IS RESTR 'BELOW.' WE GOT VISUAL WITH THE MLG AND DETERMINED HE WAS GOING TO OVERSHOOT 8000' AND PASS JUST FEET BELOW. I WAS MANNING THE RADIOS AND (A VETERAN CFI PLT) FLYING. SHE SAID HE'S CLIMBING INTO US AND IMMEDIATELY NOSED OVER PASSING 100' BELOW THE JET WHILE DESCENDING THROUGH 8300' MSL. THE CTLR CAME BACK AFTER THE DISGRUNTLED ACR PLT HAD HIS SAY; HE SAID WE PASSED 'TOO CLOSE'. THE CTLR CAME BACK (OVER THE RADIO) TO US AND SAID 'I TOLD YOU THE JET WAS RESTR BELOW AT 8000'.' I SAID; 'CTLRS HAVE VECTORED PLTS INTO MOUNTAINS; WHEN I SEE MY COURSE IS ABOUT TO INTERSECT ANOTHER PLANE'S I WILL TAKE ANY NECESSARY ACTION I FEEL IS NECESSARY.' HE (THE CTLR) GAVE ME A PHONE NUMBER TO CALL TO DISCUSS IT WITH HIM. I NEVER CALLED HIM BECAUSE I DIDN'T THINK IT WOULD DO ANY GOOD. CALLBACK CONVERSATION WITH REPORTER REVEALED THE FOLLOWING INFORMATION: CALLBACK INDICATES APPARENT OVERSHOT OF MLG BROUGHT IT TO CRUISE LEVEL OF REPORTER'S AIRPLANE. SINCE THERE WAS NO WAY TO OUT CLIMB THE MLG; THE DIVING TURN WAS THE BEST MANEUVER TO AVOID CONTACT.
