Synopsis

FO OF AN MDT ACR ACFT QUESTIONS THE LEGAL DUTY TIME OF FLYING MORE THAN 8 HRS IN A 24 HR PERIOD WITH ONLY OVER 8 HRS OF REST.

Narrative

ON DEC/XX/93 AND DEC/XY/93; I WAS SCHEDULED FOR A 2-DAY TRIP WHICH HAD SCHEDULED BLOCK TIMES OF 3:40 AND 3:30 FOR A TOTAL OF 7:10. THE SCHEDULED REST FOR THE OVERNIGHT WAS 8:40 (REDUCED REST). AT THE COMPLETION OF OUR ASSIGNED DUTIES ON DEC/XX AND ENTERING INTO REDUCED REST PERIOD WE HAD FLOWN 5:31 OF BLOCK TIME. NOTING THAT NO TIME WAS GOING TO BE DROPPED WITHIN A 24 HR PERIOD IT BECAME APPARENT THAT THE REST REQUIREMENT AS WE UNDERSTOOD IT WAS NOT SUFFICIENT FOR THE BLOCK TIME ACCUMULATED AND SCHEDULED FOR THE NEXT DAY'S; UPON ARRIVING AT OUR OVERNIGHT ACCOMMODATIONS (HOTEL). WE INFORMED SCHEDULING OF OUR CONFLICT. THEY INFORMED US THAT THE COMPANY'S INTERP OF THE REGS PERTAINING TO THIS SPECIFIC SIT HAD RECENTLY CHANGED RESULTING FROM THE RECENT CHANGE IN FSDO'S AND OUR NEW POI. MGMNT HAD INFORMED SCHEDULING OF THIS CHANGE THEREBY ALLOWING PLTS TO FLY OVER 9 HRS IN A 24 HR PERIOD WITH REDUCED REST OF 8 HRS. SCHEDULING THEN PROCEEDED TO INFORM US THAT REFUSAL TO FLY WOULD RESULT IN DISCIPLINARY ACTION. MGMNT (CHIEF PLT; ETC) WAS UNABLE TO RESPOND TO OUR QUESTIONS.
