HDG DEV. PERCEIVED TFC CONFLICT.

Narrative

WX SCATTERED TO BROKEN WITH RWY IN AREA. CLRED TO TKOF RWY 19 WITH CANALES 2 DEP MOYUTA TRANSITION. THE DEP REQUIRES THAT YOU INTERCEPT THE AUR 169 DEG RADIAL AFTER TKOF TO CANALES OR 9000 FT; WHICHEVER OCCURS FIRST; THEN TURN TO AN 080 DEG HDG TO INTERCEPT THE 169 DEG RADIAL ON COURSE. TWR CLRED US FOR TKOF; WE ASKED FOR THE NOISE ABATEMENT CLB (COMPANY PROC) BUT THE TWR DID NOT RESPOND. AS SOON AS AIRBORNE WE CONTACTED DEP AND ASKED FOR RWY HDG TO 4 DME. CTLR CLRED US TO FL410 AND TOLD US TO INTERCEPT THE 140 DEG RADIAL OF AUR TO 20 DME; THEN ON COURSE. I STARTED THE L TURN PLANNING NOT TO GO E OF THE 169 DEG RADIAL UNTIL 9000 FT FOR TERRAIN CLRNC PER THE DEP. DURING THE TURN TCASII PICKED UP TFC AT 1 O'CLOCK APPROX 10 MI. I TIGHTENED UP THE TURN BUT STILL GOT RA ADVISORY WHICH WE COMPLIED WITH. CTLR COMPLAINED THAT WE DID NOT GET ON THE 140 DEG RADIAL. HOWEVER; WE COULD NOT GET TO THE 140 DEG RADIAL QUICKLY ENOUGH TO AVOID A CONFLICT BECAUSE: 1) THE DEP SPECIFIES THAT WE STAY ON THE 169 DEG RADIAL UNTIL REACHING 9000 FT. 2) THE PROC REQUIRING US TO REQUEST RWY HDG TILL 4 DME PUTS US FURTHER S AT A HIGH RATE OF SPD EVEN WHEN THE REQUEST IS DENIED BECAUSE OF THE TIME DELAY. I STRONGLY BELIEVE THAT COMPANY SHOULD DROP THIS NOISE ABATEMENT PROC. TCASII SAVED THE DAY. AS A CREW I DO NOT SEE ANY WAY WE COULD HAVE AVOIDED THE CONFLICT. ATC SHOULD HAVE USED ALT TO SEPARATE US FROM THE TFC.
