ON TAXI OUT CLO; WE WERE GIVEN A NONSTANDARD CLRNC. AFTER TKOF; R TURN OVERHEAD ARPT TO AS NDB THEN INTERCEPT CLO 360 DEG RADIAL UNTIL 60 DME; THEN R TO INTERCEPT UG438 FL390. WE WERE TOLD MIL OPS N OF ARPT. WHEN READY FOR TKOF WE RECEIVED A RESTR OF 13000 FT UNTIL CLO 360 DEG RADIAL; 30 DME. WE REFUSED DUE TO TERRAIN CONCERNS AND NO PUBLISHED RTE. CLO TWR CANCELED THE ALT RESTR AND CLRED US FOR TKOF. DURING INITIAL CLBOUT IN R TURN OVER ARPT HDG W; TURNING N; AT 9500 FT; WE GOT A TCASII 'DSND' RA AND SAW A B727 HDG S OF UG438. TIME XX43Z; FREQ IN USE 119.1; ALTIMETER SETTING 30.03. EVASIVE ACTION TAKEN WAS STEEP CLB TO DSCNT. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: RPTR WAS NOT CERTAIN IF THEY WERE UNDER RADAR CTL FOR DEP. THE INITIAL CLRNC WAS TO CLB AND MAINTAIN 13000 FT FOR 60 MI. BECAUSE THE SURROUNDING MOUNTAINS IN THE AREA ARE FL230 AND THERE WAS NO PUBLISHED RADIAL TO FLY OUTBOUND; THE FLC TURNED DOWN THE LOW ALT RESTR. THE TWR SAID; 'OH; THEN CLRED TO CLB TO FL390.' AS THE ACFT PASSED THROUGH 9500 FT; THE FLC RECEIVED A TCASII RA FROM A DSNDING B727; WHICH HAD BEEN AT 14000 FT.
