Synopsis

ACR CREW MEMBER FLIES WITHOUT REQUIRED REST IN SPITE OF EFFORTS TO INTERP THE LEGALITIES FOR RESERVE CREW MEMBERS.

Narrative

AT XJ30 WAS RESCHEDULED TO FLY TRIP DEPARTING AT XK45 AND ARRIVING AT XP49 LCL BASE TIME. WAS ASSIGNED TO RESERVE AVAILABILITY PERIOD FROM XA00 TO XP00 THAT DAY. RESERVE AVAILABILITY PERIOD WAS EXTENDED UNTIL XQ00 PROVIDED THAT COMPENSATORY REST WOULD BE ACCOMPLISHED UPON ARR AT DEST. DEP WAS DELAYED UNTIL XL12 DUE TO MAINT. I WAS NOT SURE OF THE LEGALITY OF DEPARTING ON THIS TRIP BECAUSE IT BECAME APPARENT THAT THE FLT WOULD ARRIVE AT DEST AFTER XQ00; MEANING THAT I WOULD APPEAR TO HAVE LESS THAN 8 HRS OF CREW REST WHEN LOOKING BACK 24 HRS FROM OUR PROJECTED ARR TIME AT DEST. I ATTEMPTED TO CONTACT MY CHIEF PLT AND ASSISTANT CHIEF PLT TO CONFIRM THE LEGALITY OF THE TRIP ASSIGNMENT AND THE LEGALITY OF DEPARTING AFTER THE MAINT DELAY BUT RECEIVED NO REPLY. I SPOKE TO A SCHEDULING SUPVR WHO TOLD ME THAT I WAS LEGAL TO DEPART AT XL12 BECAUSE THE TRIP WAS SCHEDULED LEGAL. HAVING BEEN ADVISED BY A COMPANY SCHEDULING SUPVR THAT I WAS LEGAL TO FLY THE TRIP; AND LACKING ANY GUIDANCE OR RESPONSE FROM THE COMPANY'S FLT OPS LEADERSHIP; I DEPARTED AT XL12 AND ARRIVED AT THE DEST AT XQ22 LCL BASE TIME. IN HINDSIGHT; AFTER CONSULTATION WITH UNION ATTORNEYS AND CONTRACT ADMINISTRATORS; I WOULD HAVE NOT BEEN LEGAL TO DEPART SO AS TO ARRIVE AT THE DEST LATER THAN XP45 SO AS TO BE RELEASED NO LATER THAN XQ00. ALL OF THE RECENT CHANGES/INTERPS REGARDING FAR CREW REST AND DUTY PERIOD RESTRS HAVE CAUSED SO MUCH CONFUSION THAT VARIOUS COMPANY SUPVRS AREN'T EVEN ABLE TO DISSEMINATE ACCURATE GUIDANCE REGARDING FARS.
