FLC OF COMMUTER RAMP CHKED CAPT CHARTS IN BINDER NOT CURRENT.

Narrative

ON 11/91; I PLTED FLT FROM LAX TO PALM SPRINGS. UPON ARRIVING I WAS MET BY AN FAA INSPECTOR WHO EXAMINED THE CERTIFICATES AND LICENSES OF MYSELF AND MY FO. HE THEN EXAMINED OUR CHARTS AND PUBLICATIONS. THE COMPANY COMPUTER STATED THAT THE CURRENT REVISION WAS REV 45-9 (CUSTOMIZED FOR OUR COMPANY) WHICH WAS PLACED IN MY BOX ON 11/91 AND PICKED UP BY ME ON THAT DATE. IT HAD AN EFFECTIVE DATE OF 11/91 LISTED ON THE REVISION. I WAS CARRYING IT BUT HAD NOT INSERTED IT IN THE BINDER. WHEN RAMPED BY THE INSPECTOR; MY FO HAD INSERTED THE REVISION IN HIS BINDER AND HAD ALSO RECEIVED REV 46-91 WHICH HAD NOT BEEN DISTRIBUTED WHEN I LAST LEFT THE LAX OPS AREA. THE INSPECTOR STATED MY MANUALS WERE OUT OF DATE AND DELAYED OUR FLT 70 MINS. EVEN THOUGH WE STATED THAT WE WERE ONLY REQUIRED BY OUR OPS MANUAL TO HAVE ONE CURRENT SET OF MANUALS IN THE COCKPIT. I INSERTED REV 45 IN THE BINDER. HE ALLOWED US TO DEPART AT THAT TIME. SUBSEQUENTLY HE MENTIONED TO ME THAT 135.21 AND 135.83 WERE POSSIBLY NOT COMPLIED WITH. THE FOLLOWING FACTS ARE NOTED: 135.21 PERTAINS TO COMPANY OPS MANUAL. IT WAS UP TO DATE AND AVAILABLE IN THE COCKPIT AS REQUIRED. 135.83 PERTAINS TO AMONG OTHER THINGS; REQUIREMENT FOR PERTINENT AERONAUTICAL CHARTS AVAILABLE IN THE COCKPIT. THIS WAS COMPLIED WITH AS WE HAD ONE COMPLETE SET OF CHARTS AT ALL TIMES IN THE COCKPIT. FURTHER THE COMPANY OPS MANUAL WHICH BECOMES PART OF THE FARS AND IS APPROVED BY THE FAA REQUIRES ONLY 1 SET OF MANUALS AND PUBLICATIONS IN THE COCKPIT. THIS WAS COMPLIED WITH. THE COMPANY COMPUTER STATED THAT THE CURRENT REVISION ON 11/91 WAS REV 45-91 WHICH I HAD IN MY POSSESSION AT THE TIME. THE WX WAS VFR AT ALL TIMES ON 11/91 AND ONLY VISUAL APCHS AND DEPS WERE MADE BY ME ON THOSE 2 DAYS. ONLY UP TO DATE PUBLICATIONS WERE USED DURING THE PERIOD CONCERNED. FOR ALL OF THE ABOVE REASONS IT IS BELIEVED THAT NO VIOLATION WAS PERPETRATED BY ME. I BELIEVE A PRECEDENT HAS BEEN ESTABLISHED THAT AS LONG AS THE PUBLICATIONS ARE AVAILABLE AND IN YOUR POSSESSION THEY ARE NOT REQUIRED TO BE INSERTED IN ANY PARTICULAR ORDER IN THE BINDER. FURTHERMORE; WE COMPLIED COMPLETELY WITH THE COMPANY OPS MANUAL WHICH IS PART OF THE FARS. FOR THESE REASONS I BELIEVE THERE WAS NO VIOLATION OF ANY REG.
