ACR X NON ADHERENCE TO ATC CLRNC UNAUTHORIZED UNCOORD PENETRATION OF AIRSPACE. PLTDEV. CTLR FAILED TO HEAR AND CORRECT INCORRECT ALT READBACK ACR X CLB TO WRONG ALT. OPDEV.
TRAINING WAS IN PROGRESS. TFC WAS HVY. ACR X WAS TOLD 'CLB AND MAINTAIN 10000; LEAVING 3000 TURN R DIRECT MXE; MAINTAIN SPD 250.' HE READ BACK 'OK IT'S 13; DIRECT MXE OUT OF 2 AND 250.' WE CAUGHT THE INCORRECT READBACK ON THE TURNING ALT BUT NOT THE '13'. LATER; I OBSERVED THE ACFT CLBING OUT OF 11000 IN ZNY AIRSPACE. I HAD HIM DSND IMMEDIATELY TO 10000 AND ADVISE ZNY IMMEDIATELY; THERE WAS NO FURTHER INCIDENT. SUPPLEMENTAL INFO FROM ACN 201478: SHORTLY AFTER TKOF; PHILADELPHIA DEP CTL ISSUED MULTIPLE INSTRUCTIONS TO US (BEARING; ALT; AIRSPD RESTRICTION; MAY HAVE INCLUDED TFC) THE CAPT READ BACK THE INSTRUCTIONS; INCLUDING '13000' ALT. THE CTLR EITHER CONCURRED OR DID NOT ANSWER; CONTINUING TO GIVE INSTRUCTIONS TO OTHER ACFT. ( I DO NOT RECALL EXACTLY; BUT HE WAS VERY BUSY) HOWEVER; THE CAPT DID ANSWER WITH '13000' AS THE CLRNC AND SET IT IN THE ALT ALERTER. I REPEATED '13000'. PASSING 10000 FT; I CALLED FOR 'CLB CHK'. PASSING 11000 FT; THE CAPT CALLED '2 TO GO' (2000 FT TO GO). APCHING 12000 FT; THE CTLR RADIOED ACR X BEGAN IMMEDIATE DSCNT TO 10000 FT; OR WORDS TO THAT EFFECT. WE DSNDED TO 10000 FT WITHOUT INCIDENT. THE CTLR MADE NO MENTION OF A CONFLICT OR VIOLATION. BUT I GOT THE IMPRESSION THAT 10000 FT WAS THE CLRNC ALT. IF 10000 FT WAS THE CLRNC; HE FAILED TO CORRECT THE CAPT'S READBACK OF 13000 FT.
