Synopsis

WDB CLBING TO 9000 FT GETS TCASII TO CLB. TFC RPTED AT 10000 FT; RPTR CLBS TO 10500 FT.

Narrative

THE CAPT WAS FLYING THE ELMAA 2 DEP. WE WERE INSTRUCTED BY ATC TO LEVEL AT 9000 FT MSL. TFC WAS CALLED 11 O'CLOCK; 5 MI. I INFORMED ATC WE WERE IMC. AS THE CAPT WAS LEVELING AT 9000 FT; TCASII COMMANDED TFC CLB. WE FOLLOWED TCASII INSTRUCTIONS AND ADVISED ATC OUT OF 9000 FT TCASII CLB. ONCE CLR OF TFC WE WERE CLRED TO CLB TO 15000 FT. SUPPLEMENTAL INFO FROM ACN 225400: CLBING OUT OF SEA TO 9000 FT; AT 8500 FT ATC ADVISED TFC 11 O'CLOCK AT 10000 FT. LEVELING OFF AT 9000 FT TCASII STARTED 'TFC; TFC; CLB; CLB;' WHICH WE DID AND IMMEDIATELY ADVISED ATC WHO TRIED TO GET US TO LEVEL OFF. WE CONTINUED CLB TO 10500 FT; THE TCASII AT APPROX 10000 FT ADVISED TARGET PASSED. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: RPTR WAS VERY EVASIVE. HE SAID A RPT HAD BEEN MADE BY HIS CAPT TO THE COMPANY AND ALSO ANOTHER RPT TO THE PLT'S UNION AND HE WAS RELUCTANT TO DISCUSS THE MATTER FURTHER. WHEN PRESSED FOR HIS OPINION OF WHAT MIGHT HAVE HAPPENED WITHOUT TCASII HE SAID THEY MIGHT HAVE RUN INTO THE OTHER ACFT. HE DID NOT KNOW IF THE OTHER ACFT WAS LEVEL OR DSNDING.
