Synopsis

ACR FAILED TO COMPLY WITH SPD RESTR ON SID DEP.

Narrative

NORMAL TRIP SCHEDULE SDF-MIA BUT BECAUSE OF HURRICANE ERIN; TRIP RESCHEDULED TO OPERATE SDF-MCO-PHL. ON THE GND IN MCO FOR APPROX 5 HRS THEN TO PHL. FORECAST FOR MCO WAS HVY RAIN AND GUSTY WINDS WITH CONDITIONS RAPIDLY DETERIORATING. LANDED AT MCO RWY 36L WINDS WERE ALREADY 05019G24. AT OPS PERSONNEL SAID THEY WERE GOING TO TURN US AS RAPIDLY AS POSSIBLE BECAUSE HURRICANE ERIN WAS MOVING IN FASTER THAN EXPECTED. IN OPS I RECEIVED A PHONE CALL FROM MCO TWR ABOUT MY OUTBOUND CLRNC MCO-PHL. THE COMPANY DISPATCHER FILED MY OUTBOUND FLT PLAN OUT OVER THE WATER TO PHL AND THE MAN IN THE TWR SAID THAT WOULD NOT BE A GOOD IDEA WITH THE HURRICANE MOVING IN. (THANKS FOR A GOOD CATCH MCO TWR.) HE ALSO SAID PBI WAS CLOSED AND COCOA BEACH WAS FIXING TO CLOSE. WE CALLED OUR OPS AND GOT A NEW FLT PLAN LEAVING MCO ON THE MCCOY 3 DEP. UPON GETTING OUR ATC CLRNC WE LISTENED TO ATC GIVE DEP INSTRUCTIONS TO APPROX 3 ACFT AND THEY ALL WERE 'MCCOY 3 -- TRANSITIONS DO NOT EXCEED 250 KTS UNTIL ADVISED.' WHEN WE GOT OURS HE DID NOT SAY 250 KTS UNTIL ADVISED. BOTH THE FO AND MYSELF LOOKED OVER THE DEP IN THE BODY OF THE TEXT UNDER TKOF FOR RWYS 17; 18L/R AND TALKED IT OVER; I EVEN SAID 'HE DID NOT SAY 250 KTS UNTIL ADVISED' AND MY FO SAID NO HE DID NOT GIVE US 250 KTS. BY THIS TIME HVY RAIN SHOWERS AND STRONG WINDS WERE MOVING ACROSS THE AIRFIELD. AFTER START UP AND TAXI-OUT TO RWY 36L; TOOK OFF AND HAD TO DO SOME DEVIATING FOR WX. CLBING THROUGH APPROX FL190 ZJX SAID NORMAL SPD (WE WERE CLBING AT 290 KTS). MY FO TOLD ZJX WE WERE NOT GIVEN A SPD RESTR. CTR ASKED US TO LOOK AT THE MCCOY 3 DEP BECAUSE SOMETIMES THE SPD RESTR DOES NOT GET PRINTED. WELL BOTH OF US GRABBED OUR CHARTS AND THERE IT WAS AT THE TOP OF THE PAGE. WE TOLD ZJX AND HE SAID 'NO PROB HE JUST WANTED TO MAKE SURE IT WAS ON THE CHART.' IN SUMMARY I BELIEVE THIS MISTAKE STARTED IN SDF. MY FO AND MYSELF HAD A LOT OF ANXIETY ABOUT FLYING INTO THE PATH OF A HURRICANE WHICH WE EXPRESSED TO OUR BOSSES. ALSO THE RAPIDLY DETERIORATING WX AT MCO. I WOULD SUGGEST MAKING THE 250 KT RESTR NOTE IN BOLD TYPE TO HELP IT STAND OUT. SUPPLEMENTAL INFO FROM ACN 312729: AFTER A HURRIED TURN WE AGAIN WENT THROUGH THE TKOF BRIEFING INCLUDING THE DEP (SID). WHILE TAXIING OUT THE FEEDER BANDS OF RAIN STARTED AND OUR ATTENTION BEGAN TO FOCUS ON WINDS AND TSTMS THAT HAD MOVED INTO THE AREA. AFTER A FREQ CHANGE TO ZJX WE WERE TOLD TO RESUME NORMAL SPD. WE REPLIED WE WERE NOT GIVEN A SPD RESTR. JAX ASKED US TO LOOK AT THE SID AND SEE IF THE SID DID NOT INCLUDE A 250 KT RESTR. I LOOKED AND THE SID IN FACT DID SAY (TURBOJETS 250 KT). I TOLD CTR THE SID DID INCLUDE THE 250 KT RESTR; BUT WE HAD FAILED TO SEE IT. CTR REPLIED NO PROB OR CONFLICT; BUT JUST WANTED TO MAKE SURE IT HAD ACTUALLY BEEN PUBLISHED ON THE SID. THIS ONE WAS LISTED UNDER THE SID NAME. IN OUR HASTE TO DEPART IN FRONT OF THE APCHING HURRICANE; I SCANNED THE SID AND LOOKED INTO THE FAMILIAR PLACES FOR RESTRS AND FOUND NONE. ALTHOUGH WE WERE CLBING AT 270 KTS INSTEAD CTR INDICATED NO CONFLICT.
