Synopsis

NMAC BTWN A LEAR JET CLBING OUTSIDE THE CLASS B NEARBY AIRSPACE AND A DC9 ON DSCNT INTO THE MAJOR HUB ARPT.

Narrative

WHILE ON CLBOUT FROM XIP APPROX 6 MI CLR OF DTW CLASS B AIRSPACE; MY ACFT CROSSED THE PATH OF AN ARRIVING DC9 LNDG DTW ARPT. I WAS VFR; NOT ON A FLT PLAN; NOT TALKING TO DEP CTL. DC9 PICKED MY ACFT UP ON HIS TCASII. WITH THE RATE OF CLB OF MY ACFT; HIS TCASII MUST HAVE TOLD HIM TO CLB TO AVOID ME. HOWEVER; WITH MY RATE OF CLB; HIS ACTION OF CLBING PROVIDED A COLLISION COURSE. I ONLY SAW THE DC9 FOR A SPLIT SECOND AND MADE AN ATTEMPT TO ROLL RIGHT OUT OF HIS WAY. HE ROLLED L. IN MY OPINION; HAD THE DC9 CONTINUED ON HIS ASSIGNED FLT PATH AND DSNDING TO DTW; THERE WOULD NOT HAVE BEEN A NEAR MISS. HOWEVER WITH THE DC9 FOLLOWING THE COMMANDS OF HIS TCASII; HE PUT THE 2 ACFT IN THE SAME AIRSPACE. ALTHOUGH BOTH ACFT WERE CORRECT IN WHERE THEY WERE; DC9 IFR FLT PLAN UNDER APCH CTL TO DTW -- LEAR JET VFR NOT TALKING TO ANYONE AND BOTH ACFT 5-10 MI FROM EDGE OF CLASS B AIRSPACE. THIS COULD BE AVOIDED; LEAR JET COULD HAVE BEEN TALKING TO DEP WHILE VFR AND HAD BEEN ADVISED OF TFC; DC9 WHEN IN VFR CONDITIONS NOT ALWAYS FOLLOW TCASII. POSSIBLE LOOK FOR OTHER ACFT AND AVOID OTHER ACFT VISUALLY.
