DC10 CARGO FLT EXPERIENCES AN ALTDEV ALT UNDERSHOT XING RESTR NOT MET IN SID. DEP CTLR CALLS FOR AN EARLY TURN; PLACING THE ACFT IN A NO WIN SIT WITHOUT AMENDED CLRNC.

Narrative

FLT WAS CLRED LOUPE 9 SID OUT OF LAX NOT TO EXCEED 250 KIAS. AFTER TKOF; DEP CLRED FLT DIRECT TO LAX. FLT CROSSED LAX AT 10000 FT MSL. DEP WAS ADVISED THAT WE COULD NOT MEET THE XING RESTR OF 'AT OR ABOVE 13000 FT AT KEGGS.' DEP RESPONDED; 'YOU BARELY MADE YOUR 10000 FT RESTR; MAINTAIN 250 KTS.' ACFT CROSSED KEGGS AT 11800 FT. THIS SIT COULD HAVE BEEN AVOIDED IF WE HAD NOT BEEN GIVEN SUCH AN EARLY TURN TO LAX. DEP ALSO COULD HAVE VECTORED US OFF OF THE SID OR CLRED US TO CROSS KEGGS AT A LOWER ALT. WHEN DEP RESTR US TO 250 KTS AT LAX THAT FURTHER COMPLICATED THE ABILITY OF A 462000 LB ACFT IN COMPLYING WITH THE SID. SUPPLEMENTAL INFO FROM ACN 338363: AFTER PASSING THE LAX VOR AT OR ABOVE THE REQUIRED 10000 FT; I TOLD DEP THAT OUR NEXT XING RESTR OF AT OR ABOVE 13000 FT AT KEGGS WOULD BE CLOSE. ALTHOUGH I ACCEPTED THE EARLY TURN TO THE LAX VOR; I BELIEVE THE CTLR KNOWINGLY GAVE AN EARLY TURN. MY VAGUE TERMINOLOGY ALSO CONTRIBUTED TO THE LACK OF CORRECTIVE ACTION. THESE ARE 2 VALUABLE LESSONS THAT I WILL NOT FORGET.
