THE FLC IGNORED THE FACT THE GS AND MARKERS WERE OTS WHILE CONDUCTING THE ILS TO RWY 29. THE FLC GENERATED THEIR OWN DME CRITERIA FOR THE OM AS THE OM DME WAS NOT PUBLISHED.
COMING INTO OAK AFTER DEPARTING BOI; ACR X WAS CLRED FOR THE ILS RWY 29. THE CAPT AND FO HAD MISSED THAT GS WAS OUT ON NOTAMS AND SO DIDN'T HEAR THAT GS; OM; MM; AND IM WERE OTS. ACR X SHOT THE APCH BUT HAD NO WAY OF KNOWING WHEN TO DSND FOR STEP-DOWN WITH OM OTS. AFTER BREAKING OUT OF THE CLOUDS AT 1100 FT AGL WE WERE TOO HIGH TO SAFELY LAND. AFTER MISSED APCH; WE AGAIN SHOT THE ILS RWY 29 TO OAK USING APPROX DME TO ENSURE INSIDE OF OM AND LANDED UNEVENTFULLY. AFTER DEBRIEFING; WE DECIDED THAT WITH NO GS OR MARKERS WE WEREN'T LEGAL TO SHOOT THAT APCH. ALL 3 CREW MEMBERS HAVE SUBMITTED NASA RPTS. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: THE RPTR STATED HE DID NOT HEAR THE ATIS CLRLY AS IT WAS BREAKING UP. THE CREW CONFIRMED PRIOR TO COMMENCING THE APCH THE GS AND MARKER BEACONS WERE OTS. THE CTLR INQUIRED IF THE CREW HAD A PROB WITH THAT. THE CREW SAID NO. THE FLC IMPROVISED A DME TO APPROX THE OM POS. THE CTLR DID NOT VOLUNTEER HIS SVC TO CALL OUT WHEN THE FLC WAS PASSING THE OM WHICH WOULD HAVE MADE THE APCH TECHNICALLY LEGAL TO LOC ONLY MINIMUMS.
