AN SMA PLT EXERCISED HIS EMER AUTH AND LANDED ON A RWY THAT WAS CLOSED BY NOTAM. ARPT PROB OBSTRUCTION DISABLED ACFT ON THE ONLY RWY.

Narrative

I WAS PREPARING TO TAKE UP A LOAD OF SKYDIVERS. WE WITNESSED AN AEROSTAR LAND. WHEN THE AIRPLANE LANDED; THE NOSE GEAR COLLAPSED. THE AIRPLANE CAME TO REST APPROX TWO THIRDS DOWN THE RWY. THERE IS AN FSS ON THE FIELD. WE CONTACTED THE FSS ON THE PHONE TO ASK ABOUT THE RWY. WE WERE ADVISED THAT THE RWY COULD NOT BE CLOSED BY THE FSS; AND ONLY THE ARPT MGR COULD CLOSE THE RWY. WE TOLD FSS THAT WE WOULD USE THE LATER ONE HALF OF THE RWY SINCE THE RWY IS 8000 FT LONG; AND CONTINUE PARADROP OPS. I TOOK OFF WITH A LOAD OF SKYDIVERS. AFTER THE JUMPERS WERE OUT AND I WAS IN MY DSCNT; EGLIN APCH ADVISED ME THAT THE RWY AT CEW WAS NOW NOTAMED CLOSED TO REMOVE THE DISABLED AIRPLANE. I WAS TOLD BY FSS THAT IT SHOULD NOT BE VERY LONG UNTIL THE RWY WAS OPENED UP AGAIN. I ENTERED THE TFC PATTERN AND BEGAN TO CIRCLE THE RWY IN THE PATTERN. THIS WAS MY THIRD LOAD OF SKYDIVERS THAT I HAD FLOWN. ACCORDING TO MY WATCH I WAS DOWN TO MY MINIMUM FUEL REQUIREMENTS FOR VFR FLT. MY GAS GAUGE WAS SHOWING ME EMPTY. AFTER CIRCLING FOR APPROX 10 MINS; I GOT NERVOUS AND DECIDED TO MAKE A PRECAUTIONARY LNDG ON RWY 35. I MADE A TFC ANNOUNCEMENT THAT I WAS GOING TO LAND ON RWY 35. I NEVER CAME NEAR THE DISABLED ACFT; PEOPLE; OR EQUIP ON THE RWY. I AM SORRY THAT I BROKE FAR 91.139 AS IT RELATES TO NOTAMS. BUT I WAS DOWN TO MINIMUM FUEL AND I EXERCISED MY RIGHT TO FAR 91.3. IN THE FUTURE; I WILL CARRY MORE FUEL THAN THE FARS CALL FOR. PLUS; I WILL NOT DEPART ON A RWY WITH A DISABLED ACFT ON IT -- EVEN IF IT IS OPEN.
