Narrative

DEPARTED ORL XA46 EST; ASSIGNED HDG 250 DEGS TO MAINTAIN 1500 FT MSL. TWR GAVE NO TA'S AND HANDED US TO APCH/DEP CTL. JUST AFTER CHK-IN; WE SAW A TCASI TARGET AT OUR ALT ABOUT 5 MI AHEAD. WE COULD NOT SEE THE TARGET. THEN TCASI ALERT SOUNDED; WE SAW THE PLANE HEADED TOWARD US. I DSNDED 200 FT AND TURNED R SLIGHTLY TO PASS BELOW AND R OF OTHER PLANE. THEN DEP ASKED IF WE SAW TFC AND STATED THAT HE WAS UNDER EXECUTIVE TWR CTL; APOLOGIZED FOR NOT WARNING US. AFTER LNDG IN MGM; I CALLED ORL TWR AND TALKED WITH CTLR. HE STATED THAT HE SHOULD HAVE WARNED US BEFORE FREQ CHANGE BUT DIDN'T. DURING OUR OP ON GND AND TWR; WE HAD TROUBLE HEARING THEIR INSTRUCTIONS DUE TO BACKGND NOISE OF COMMOTION IN TWR. I ASKED CTLR WHAT WAS GOING ON; AND HE STATED IT WAS SHIFT CHANGE WITH LOTS OF PEOPLE IN TWR. WHEN I ASKED IF HE WAS BEING DISTR HE SAID HE WAS. I BELIEVE SERIOUS CONSIDERATION SHOULD BE GIVEN TO CHANGE RULES TO ALLOW TURBINE EQUIP TO USE THE FIRST 1000 FT OF SPACE INSIDE CLASS B AIRSPACE. THE SPD DISPARITY OF 200 KTS VERSUS 100 MPH IS JUST TOO GREAT. ALL GA ACFT ARE COMPRESSED INTO 1000 OR 2000 FT. EVERY TIME I GO TO ORL; I GET AT LEAST ONE TA ON TCASI; AND I HAVE GOTTEN 3. ALMOST ALL HAVE REQUIRED EVASIVE ACTION. NOW I LEARN THAT TRACON WANTS TO LOWER THE FLOOR OVER EXECUTIVE EVEN MORE.
