B737-300 FLC HAS NMAC WITH MIL ACFT. THEY HAD RECEIVED A TCASII RA AND WERE TOLD BY CTR TO MAINTAIN ALT. THEY RESPONDED TO THE RA. HAD THEY NOT DONE SO THEY WOULD HAVE HAD ONLY 200 FT SEPARATION FROM THE MIL ACFT. CTLR SAID THE ACFT CAME OUT OF THE RESTR AREA.
WE WERE DSNDING FROM FL210 ON THE BARET 4 ARR TO SAN AND GIVEN A HDG OFF COURSE TO 170 DEGS AND AN ALT OF 12000 FT. I SAW ON TCASII TFC ON OUR L ABOUT 9-10 O'CLOCK AND IT IMMEDIATELY TURNED TO AN RA. THE CTLR; ZLA; TOLD US TO STOP OUR DSCNT AT 17000 FT. TCASII WAS NOW TELLING US TO CLB. THE TFC PASSED UNDER US AT 16800 FT AND WE WERE AT 17500 FT. THE CTLR SAID THE TFC CAME OUT OF THE RESTR AREA. I NEVER VISUALLY SAW THE TFC. I FEEL THE CLRNC TO LEVEL AT 17000 FT WAS UNSAFE BECAUSE WE CAME TOO CLOSE TO THE RENEGADE TFC WHO MAY OR MAY NOT HAVE BEEN IN CONTACT WITH THE CTLR AT ZLA (128.6). THE CTLR SAID THAT HE JUST POPPED UP ON HIS RADAR SCREEN. SINCE SAN IS SO BUSY LATE AT NIGHT; MAYBE THERE NEEDS TO BE MORE CTLRS ON DUTY FOR THE HVY TFC AROUND THERE. CALLBACK CONVERSATION WITH RPTR REVEALED THE FOLLOWING INFO: RPTR STATES THAT THERE HAS BEEN NO FOLLOW-UP. RPTR DID NOT FILE A COMPANY RPT. ATC INDICATIONS OF NOT KNOWING ABOUT THE TFC SEEM STRANGE IF IT TRULY WAS INSIDE THE RESTR AREA. RPTR DID FOLLOW TCASII RA TO CLB AND STILL WAS QUITE CLOSE TO THE TFC.
