Synopsis

A COMMUTER CREW JUST AIRBORNE OFF RWY 25R AT LAX REFUSE TO MAKE AN IMMEDIATE LEFT TURN WHEN A TURBO JET ON SHORT FINAL TO RWY 25L MAKES MISSED APCH.

Narrative

IN LAX ACR Y WAS ON A MISSED APCH ON RWY 25L. HE WAS ON ABOUT A 2 MILE FINAL. JUST AS WE LIFTED OFF RWY 25R AT APPROX 200-300 FT; THE TWR TOLD US TO TURN LEFT HEADING 200 DEG FOR TFC. WE (THE CREW) KNOWING; HEARING (TWICE) AND CONFIRMING ON TCAS THAT THE TFC WAS BEHIND TO OUR LEFT AND COMING UP FAST; I TOLD CTLR 'UNABLE' TO TURN LEFT. HE GOT REAL MAD AND SAID TURN LEFT AT LEAST 2 MORE TIMES; WHICH I DECLINED. I THEN SUGGESTED THAT WE WOULD FLY RWY HEADING AND MAINTAIN 1000 FT; INSTEAD OF OUR ORIGINAL CLRNC TO 3000 FT; TO STAY PARALLEL AND BELOW TFC. ALTHOUGH HE WAS MAD HE SAID OKAY. I; UPON LNDG IN SAN DIEGO; CALLED LAX TRACON AS INSTRUCTED. THE TWR SUPVR THEN ASKED ME WHY WE HADN'T COMPLIED WITH THE TWRS INSTRUCTIONS. I STATED THESE REASONS: 1) I DID NOT WANT TO MAKE A LEFT TURN INTO KNOWN TFC. 2) WX WAS ABOUT 900 FT OVERCAST WITH TOPS ABOUT 1400 FT; AND I COULD NOT SEE THE TFC; THE TWR COULD NOT SEE THE TFC; AND THE TFC COULD NOT SEE US. 3) THE EARLY LEFT TURN WOULD HAVE TAKEN US RIGHT OVER A TOWN (EL SEGUNDO) WITH ANTENNAS; BUILDINGS; SMOKE STACKS ETC. SINCE CEILING WAS RAGGED I DIDN'T WANT TO HEAD RIGHT FOR OBSTACLES IN IMC AND I DIDN'T KNOW HOW HIGH THEY WERE. 4) WE WERE STILL CLRED TO 3000 FT; AND THE TFC WAS LEVEL AT 2000 FT; AT OUR 8 O'CLOCK POS AND CLOSING FAST; WE COULD HAVE AND WOULD HAVE CLBED UP INTO TFC. 5) LASTLY; THERE IS ONE LAST ISSUE I WOULD LIKE TO COMMENT ABOUT. IN ADDITION TO THE 4 OBVIOUS SAFETY REASONS ABOVE; I WAS ALSO CONCERNED ABOUT THE NOISE SENSITIVE AREA OVER EL SEGUNDO. IN LIGHT OF THIS; I WAS TRYING TO SAY SOMETHING TO THE TWR TO HINT TO HIM I DID NOT WAS TO TURN INTO TFC AND WHY. I DIDN'T WANT TO GET ANYBODY IN TROUBLE BY SAYING THE OBVIOUS ON FREQ. UNFORTUNATELY; THE LAST THING ON MY MIND WAS THE FIRST THING OUT OF MY MOUTH; AND I STATED I DIDN'T WANT TO TURN BECAUSE OF NOISE ABATEMENT. I DIDN'T SAY THIS COMMENT UNTIL MY SECOND OR THIRD XMISSION. UNDERSTANDABLY; TWR WAS VERY ANGRY AS TO THINK I WOULDN'T TURN ONLY BECAUSE OF NOISE. I AM ALSO CONVINCED THAT THIS ANGER WAS EXTREME (AND CONFUSING) THAT THE OTHER OBVIOUS FIX TO THIS PROBLEM WOULD HAVE BEEN TO VECTOR THE OTHER TFC WHO WAS HIGHER AND ON THE LEFT. TO THE LEFT OR CLB. BASICALLY THE TWR GOT FOCUSED OR TUNNEL VISION ON OUR NOT COMPLYING. I THEN ASKED MY QUESTION OF WHY WERE WE CLRED FOR TKOF ON 25R WITH AN ACFT ON SHORT FINAL IMC ON A GAR ON OUR LEFT (25L). THE TWR SUPVR GOT REAL QUIET AND SAID 'WE ARE LOOKING INTO THAT.' I ALSO ASKED WHY WE WERE VECTORED TOWARDS TFC INSTEAD OF AWAY OR STRAIGHT AHEAD. HE AGAIN GOT REAL QUIET AND SAID 'WERE LOOKING INTO THAT TOO!'
