B757 FLC WERE APPROVED TO DEVIATE AROUND WX AND THEN SUBSEQUENTLY ARTCC CTLR ADVISED THAT THEY WERE ENTERING RESTR AIRSPACE AND TO TURN TO ANOTHER HEADING WHICH WOULD TAKE THEM INTO A TSTM. FLC REFUSED HEADING AND THE CTLR REQUESTED THAT THEY SQUAWK EMER CODE.

Narrative

ACFT WAS CLBING OFF OF LAX VIA THE LOOP2 SID; DAG TRANSITION. VICINITY OF COOPP INTXN; REQUESTED AND WERE GRANTED 25 DEGS L DEV DUE TO WX ACTIVITY ON THE AIRWAY BTWN COOPP AND DAG; AS WELL AS ONE WELL-DEFINED CELL RIGHT ON TOP OF DAG. SOMETIME LATER IN THE VICINITY OF THE DAG 250 DEG RADIAL AT APPROX 25 DME; CTR SAID '...FLY HEADING 070 DEGS.' A HEADING OF 070 DEGS WOULD PUT US RIGHT IN THE CELL OVER DAG; SO WE RESPONDED 'HOW ABOUT A 060 DEG HDG FOR THE CELL IN FRONT OF US.' CTR CAME RIGHT BACK WITH 'YOU ARE ENTERING AIRSPACE YOU CANNOT GO INTO; FLY HEADING 070 DEGS; SQUAWK 7700.' WE TURNED TO THE HEADING AND VERIFIED THE XPONDER CODE; THEN ENTERED 7700. I TOLD FO WE WOULD GIVE HIM ABOUT 15 MI; THEN TURN AS WE WOULD NOT FLY INTO THE CELL. AFTER ABOUT 10 MI WE WERE ISSUED A 055 DEG HDG FOR ABOUT 20 MI; THEN CLRED DIRECT LAS ON COURSE. ONCE CLRED ON COURSE WE WERE REISSUED OUR PRIOR XPONDER CODE. I FEEL THAT THE CTLR DID NOT CONSIDER SPECIAL USE AIRSPACE; THE BARSTOW MOA AND R-2502E; WHEN HE APPROVED OUR WX DEV; AND FAILED TO MONITOR OUR IMPENDING AIRSPACE CONFLICT UNTIL THE LAST MOMENT.
