Synopsis

A DO 328 CAPT FAILED TO MAKE THE REQUIRED TURN TO 280 DEGS ON THE TEB 5 DEP THEREFORE ENTERING EWR AIRSPACE.

Narrative

WE WERE DEPARTING TEB RWY 24. AS THE PNF; I BRIEFED THE TEB 5 SID FROM RWY 24. THE CAPT ASKED A COUPLE OF QUESTIONS ABOUT THE PROC; WHICH I CORRECTED AND ANSWERED. THE PROPER PROC IS TO FLY RWY HDG TO 1500 FT; MAKE AN IMMEDIATE R TURN TO 280 DEGS; AND CLB TO 2000 FT ONLY AFTER REACHING 4.5 DME. I BUGGED 280 DEGS ON MY DG AND RWY HDG ON THE CAPT'S; AND BRIEFED HIM SO. HE ASKED THAT I VERIFY CLBING ONLY AFTER 4.5 DME; WHICH I DID. WE DISCUSSED REDUCING PWR IMMEDIATELY TO AVOID EXCEEDING 1500 FT AND 200 KTS. AFTER TKOF; I CALLED THE ALTS TO ENSURE A LEVEL OFF AT 1500 FT. AT 1500 FT; I CALLED '2-8-0;' BUT THE CAPT DID NOT TURN. BECAUSE THIS CAPT HAS A HISTORY OF DECLINING ADVICE OR DIRECTION FROM HIS FO'S. I HESITATED BRIEFLY BEFORE REALIZING THAT HE WAS WAITING FOR 4.5 DME TO INITIATE THE TURN. BEFORE I COULD REACT; ATC CONTACTED US TO ASK OUR HDG; TO WHICH I REPLIED 'RWY HDG' WHILE GESTURING FOR A TURN. ATC WAS RIGHTFULLY ANGRY; AS WE WERE ENCROACHING; OR ABOUT TO ENCROACH; INTO EWR AIRSPACE. WE WERE CHASTISED AND ORDERED TO TURN TO 280 DEGS. THE CAPT NEVER COMMENTED. I BELIEVE THAT THIS INCIDENT OCCURRED THROUGH A LACK OF COM BETWEEN THE CAPT AND MYSELF IN THAT HE STILL DID NOT HAVE A FULL UNDERSTANDING OF THE SID AND MY HESITATION TO TAKE CORRECTIVE ACTION AFTER HIS FAILURE TO RESPOND TO MY CALL TO TURN TO 280 DEG HDG; BASED IN PART ON HIS HISTORY OF REACTING BADLY TO ADVICE OR DIRECTION FROM HIS FO'S. I AM CURRENTLY TAKING STEPS WITH OUR COMPANY TO RESOLVE THE HOSTILITY TOWARD FO'S DOING THEIR JOB AND TO FIND WEATHER NEW PROCS SHOULD BE IMPLEMENTED TO ENSURE THAT SIDS ARE MORE THOROUGHLY BRIEFED AND UNDERSTOOD.
