B747-400 FLT CREW REFUSES INTERNATIONAL REASSIGNMENT FOLLOWING AN ENGINE FAILURE EMERGENCY ON THE ORIGINAL FLT. CITE FATIGUE AND VIOLATION OF FARS.
AFTER HAVING ENG #4 BLOW UP AT V1 ON DEP; WE RETURN ENG OUT. 1 HR LATER; WE ARE TOLD BY FLT OPS DUTY MGR AND LCL MGRS ON SITE TO FLY REASSIGNED TRIP. THIS TRIP WOULD LEAVE NEXT DAY. WE ARE FAR FROM BEING DONE WITH PAPERWORK; COMS AND MATTERS SURROUNDING THIS BLOWN UP ENG. END OF 'REAL' DUTY TIME IS FAR AWAY. ALSO; IN ORDER TO DO PROPER FLT PLANNING THAT I NEED TO DEPART EARLY; I NEED TO LEAVE HOTEL BEFORE SECURITY OPENS. COULD NOT IMAGINE A RESTFUL NIGHT EITHER. ADDITIONALLY; THE NEW ASSIGNMENT REQUIRES US TO FLY FOR 13 HRS 32 MINS DEPARTING EARLY; LNDG LATE; AND THEN REST FOR 10 HRS 14 MINS; THEN DEPART AND FLY SCHEDULED AT 13 HRS 16 MINS. REFUSED ASSIGNMENT DESPITE MGMNT TELLING US 'THE COMPANY IS REALLY SHORT ON PLTS; WE NEED YOU TO FLY.' I FAIL TO SEE THIS AS A VALID REASON TO SCHEDULE UNSAFE FLT OPS VIA IMPROPER REST. UNABLE TO COMPLY WITH FAA ACT OF 1958 AND FAR 121 WHICH DEMANDS THAT THE FAR 121 ATP PIC DEMONSTRATE 'EXTRAORDINARY CARE.' FISCAL PROBS WITH PROPER STAFFING IS NOT SOMETHING I CAN FIND IN THE FAR'S THAT ALLOWS MY ATP LICENSE TO CONDUCT SOMETHING LESS THAN 'EXTRAORDINARY CARE.' CANNOT SEE HOW THIS ASSIGNMENT COMPLIES WITH FAR 21.485 AND SAFE JUDGEMENT I AM CHARGED WITH DEMONSTRATING.
