C560 FLT CREW ACCOMPLISHED FLT WITH KNOWN MALFUNCTION (UNABLE TO RETRACT GEAR) WITHOUT OBTAINING MAINT FERRY PERMIT.
AFTER TKOF AND POSITIVE RATE OF CLB WAS ESTABLISHED; THE LNDG GEAR HANDLE WOULD NOT MOVE TO THE UP POS. WE CONTINUED A CLB TO A SAFE ALT; AND STARTED TO ANALYZE THE PROB. AFTER FINDING THAT ALL CIRCUIT BREAKERS WERE IN; AND CONFIRMING THAT THE LNDG GEAR HANDLE WOULD NOT MOVE; WE DETERMINED THAT WE DID NOT HAVE ENOUGH FUEL TO REACH DEST WITH THE LNDG GEAR DOWN. WE REQUESTED A RETURN TO ZZZ. AFTER LNDG IN ZZZ; WE CALLED DISPATCH TO RPT THE MECHANICAL CONDITION. DUE TO THE LATE HR WE DID NOT REACH DISPATCH AND LEFT A MESSAGE. THE OWNER RETURNED THE CALL ABOUT 15 MINS LATER. FO AND I DISCUSSED THE SAFETY ISSUES INVOLVED WITH FERRYING THE ACFT HOME WITH THE LNDG GEAR DOWN WHILE WAITING FOR A CALL BACK. WE DETERMINED THERE WERE NO SAFETY ISSUES ASSOCIATED WITH THIS OP. AFTER RECEIVING A CALL BACK FROM THE OWNER; IT WAS DECIDED THAT WE WOULD FUEL THE ACFT; AND RETURN TO DEST. IT WAS NOT UNTIL WE WERE ENRTE; AND ALMOST TO OUR DEST THAT I REALIZED THAT WE SHOULD HAVE HAD A FERRY PERMIT FOR THIS FLT. WE LANDED WITHOUT INCIDENT AT DEST. CREW RECOMMENDATIONS: IT IS THE CREW'S RECOMMENDATION THAT ANYONE ASSUMING A DISPATCH FUNCTION REFER THE CREW TO THE ON CALL MAINT PERSONNEL TO MAKE SURE THAT THIS OVERSIGHT DOES NOT OCCUR IN THE FUTURE.
