Synopsis

A LIGHT PLANE PLT FLEW INTO THE RESTRICTED EAST RIVER AREA IN PART BECAUSE HE WAS GIVEN AN INACCURATE BRIEFING FROM FSS.

Narrative

I PLANNED TO FLY FROM FRG TO ZZZ UNDER VFR FIRST SOUTH; THEN WESTBOUND ALONG THE SHORE; THEN NORTHBOUND OVER THE VERRAZANO BRIDGE ALONG THE HUDSON RIVER CLASS B EXCLUSION. WHILE DOING THIS I PLANNED AS WELL TO FLY UP THE EAST RIVER AND RETURN AT THE NORTHERNMOST POINT OF THE CLASS B EXCLUSION BACK TO THE SOTHERN TIP OF MANHATTAN AND THEN TURN NORTH UP THE HUDSON RIVER. THE EAST RIVER AND HUDSON PART OF MY RTE I PLANNED TO FLY NOT HIGHER THAN 1000 FT MSL. I PLANNED THE TRIP VERY CAREFULLY WITH THE LATEST VFR TERMINAL AREA CHART OF NEW YORK WHICH IS GOOD TO NOV 2008. JUST BEFORE TAKEOFF FROM FRG I CALLED 1-800-WX-BRIEF FOR BRIEFING. WHEN I GOT MY BRIEFING I EXPLICITLY ASKED IF THERE ARE ANY RESTRS FOR THE EAST RIVER EXCLUSION OTHER THAN THOSE MENTIONED IN THE VFR TERMINAL AREA CHART OF NEW YORK. I EVEN REFERRED TO THE ACCIDENT THAT HAPPENED A COUPLE OF YEARS AGO WHEN AN AIRPLANE HIT A BUILDING AND ASKED AGAIN FOR ANY RESTRS OR ALTERATIONS OF THE EAST RIVER PROC. THE BRIEFER EXPLICITLY TOLD ME THAT HE DOES NOT KNOW ABOUT ANY RESTRS FOR THE EAST RIVER; SO I FINISHED THE BRIEFING AND TOOK OFF. THE FLT TOOK PLACE AS PLANNED INCLUDING THE EAST RIVER DIVERSION. AFTER I HAD BEEN REASSURED BY THE BRIEFER THAT THE EAST RIVER IS OPEN; I FELT ABSOLUTELY SURE THAT I WOULD COMPLY WITH THE REGULATIONS. THE REASON WHY I FILED THE RPT NOT EARLIER THAN TODAY IS; BECAUSE I JUST COINCIDENTALLY LEARNED THAT THERE IS A NOTAM STILL IN EFFECT SINCE 2006 CONTAINING RESTRS USING THE EAST RIVER EXCLUSION.
