Synopsis

TWO MLG ACFT ON LOUPE 4 SID OUT OF SJC HAD LESS THAN STANDARD SEPARATION DUE TO POOR CTLR TECHNIQUE.

Narrative

ON DEP CLIMB FROM SJC USING THE LOUPE 4 SID WE WERE CLRD TO CROSS THE SJC VOR AT OR ABOVE 11000' TO MAINTAIN FL230. AT 2 DME S OF SJC ON A HDG OF 300; I NOTICED AN MLG Y AT 1:30 AND 1 MI CONVERGING. I DISCONNECTED THE AUTOPLT AND PUSHED UP THE POWER AND RAISED THE NOSE. AS I DID THIS THE CONFLICT ACFT APPEARED TO LOWER HIS NOSE AND SHORTLY AFTER IT PASSED DIRECTLY BELOW AT APPROX 800'. WE QUESTIONED CENTER AND HE RESPONDED BY SAYING THAT ACFT IS ON BAY APCH AT 11000'...NOW HE'S GOING DOWN TO 10000'. SUPPLEMENTAL INFORMATION FROM ACN 86229: HE PASSED DIRECTLY UNDER US APPROX 800-1200'. SUPPLEMENTAL INFORMATION FROM ACN 86341: OUR CLRNC WAS THE LOUPE 4 SID FROM SJC. AFTER TKOF AND CONTACTING BAY DEP ON 121.3 WE WERE CLRD TO 11000 MSL AND INSTRUCTED TO 'KEEP THE TURN IN TIGHT' PRIOR TO REACHING THE SJC 005 DEG R AND 5000' MSL. OUR UNDERSTANDING WAS THIS MEANT ALSO BACK TO THE VOR. AS WE WERE TURNING BACK TO VOR AND AT ABOUT 10000' MSL WE SAW AN MLG X ABOVE AND MOVING FROM 11-12 O'CLOCK. AT THE SAME TIME WE SAW THE MLG X. DEP TOLD US TO STOP AT 10000' MSL WHICH WE DID WITH VERY LITTLE PROBLEM. WE PASSED WELL BELOW AND BEHIND THE MLG X AND SHORTLY RECEIVED CLRNC TO CONTINUE OUR CLIMB TO 11000' AND TO THE VOR. I BELIEVE THIS INCIDENT WOULD NOT HAVE HAPPENED HAD THE STATEMENT 'KEEP THE TURN IN TIGHT' BEEN OMITTED AS WE WOULD HAVE REMAINED WEST OF THE OAK VOR 121 DEG R.
