CRJ700 Captain discovers Fueler using single point refueling point when MEL restriction requires overwing refueling. The Fueler is aware of the MEL restriction but was told to 'try it and see if it works'. A baggage loading issue is also discussed.

Narrative

Upon receipt of dispatch release; [the] crew observed that the high level fuel sensors were deferred. After consulting DMEL and MEL; it was confirmed that the left wing would require over-wing fueling. At this point; [the] crew observed that the Fueler was single-point fueling the aircraft. First Officer went out to tell the Fueler that over-wing fueling was required. It was observed that a placard was installed on the fuel door. The fuel company employee stated that he was aware of the deferral but had been told to 'try it and see if it works'. The deferral was due to the sensor failure causing a spill out of the left wing. Operations were contacted and a fuel company Supervisor was requested; along with a Ramp Manager. By this time; the Fueler had completed fueling the aircraft; fortunately without causing a spill. Careless disregard of procedures by fuel contractor because it was more convenient to single-point refuel the aircraft. Initiate FAA enforcement against the Fueler for willful disregard of MEL restrictions.After this event the crew observed that the valet bags were listed as being loaded in the aft baggage compartment when; in fact; they were loaded in the forward baggage compartment. This could have caused a dangerous out-of-trim condition. Ramp Supervisor was advised of the error; correct data was entered into ACARS and flight was completed uneventfully.
