Incident Overview
A VFR flight at night attempted to contact Albany Approach Control (ALB) when the aircraft was approximately 40 miles from its destination. The controller answered the call and reported that the aircraft's transponder was not being received, but the pilot did not hear the response because the aircraft was too far away. The pilot was advised via an airliner to call again after proceeding further inbound.
Communication and Descent
About 13 minutes later, the pilot established contact with ALB approximately 27 miles southeast in the vicinity of Pittsfield, at an altitude of 2,500 feet MSL. The pilot asked, "My altitude of 2,500, is that okay?" The controller, interpreting the query as referring to the quality of the transponder readout of 2,500 feet, replied, "Affirmative." The controller then asked if the pilot was flying VFR, and the pilot confirmed. Shortly thereafter, contact with the aircraft was lost. The aircraft descended into rising terrain at an elevation of about 1,800 feet.
Mechanical and Weather Factors
No preimpact mechanical problem was found. During the preflight weather briefing, Flight Service Station personnel did not advise the pilot of the flight precaution regarding obscured mountains. The minimum vectoring altitude (MVA) in the area was 4,000 feet MSL. Another pilot operating from Pittsfield reported that the bases of overcast were ragged at 2,500 to 3,000 feet MSL and that higher terrain was obscured by clouds.
Search and Notification
The Rescue Coordination Center (RCC) was not notified, leading to a delay in the search. The controller's supervisor notified the Air Route Traffic Control Center (ARTCC) in accordance with procedures for an IFR aircraft. ARTCC did not notify the RCC because the aircraft was operating VFR. However, the crash was not survivable.
