Incident Overview
A pilot operating on an instrument flight rules (IFR) flight plan transitioning to visual flight rules (VFR) conditions failed to set the correct transponder code as assigned by air traffic control. The local controller reminded the pilot to set the correct code, and the pilot replied, "I'm having a problem right now . . . I've got to get straightened away . . ." The controller again reminded the pilot about the transponder code and advised of traffic ahead.
Sequence of Events
The aircraft subsequently began a shallow descending left turn, struck the tops of three tall palm trees, and crashed into an apartment complex, where it burned. Several witnesses reported engine problems, but no preimpact part failure or malfunction was found during the investigation.
Investigation Findings
The investigation determined that the pilot was properly certificated for the flight. However, the pilot had recently failed an instrument flight test, and the Federal Aviation Administration (FAA) was in the process of revoking his instrument privileges. The pilot reportedly was experiencing serious personal and financial problems stemming from his wife's illness and extensive hospitalization. His flight instructor reported that these problems were adversely affecting his flying skills.
